This can lead to productive exchanges and greater citation of the published work.</p> Presidential Inauguration: Pertanggungjawaban Presiden Indonesia Dalam Prosedur dan Materi Sumpah Jabatan <p>This article examines the validity and accountability of Indonesian’s President based on the procedures and content of the office’s oath. The research method used is doctrinal, with a legislative approach and a constitutional comparison of fifty countries in the world that adhere to the presidential system of government. The results shows normatively, the authority to inaugurate the president is given to the People's Consultative Assembly (MPR) based on Article 9 of the 1945 Constitution. However, in practice, MPR doesn’t inaugurate the president because it only witnesses the president reciting the oath. Nevertheless, the practice of inauguration is still valid. A comparison of fifty countries shows a trend of the president taking the oath before parliament with the alternative of taking the oath before the Supreme Court (MA) if the MPR is absent. This trend is also applied in Indonesia, but ideally swearing before the Supreme Court is no longer relevant in Indonesia. Seeing the coherence and logical consequences of the president's relationship in formal accountability is closer to the Constitutional Court, in this case as a priveligiatum forum for impeachment events. Thus, the procedure for swearing in the president is more appropriate in front of the MPR, witnessed by the Chairperson of the Constitutional Court. For the oath content , although it is not explicitly stated to whom, the moral responsibility of the president is still addressed to the people as the mandate giver.</p> Winda Sari Fitra Arsil Nurul Insi Syahruddin Desi Fitriyani Copyright (c) 2023-12-15 2023-12-15 184 207 10.24252/ Perilaku Curang Karyawan Pada Struk Belanja : Perlindungan Hukum terhadap Konsumen <p>Minimarket di daerah-daerah yang menyediakan kebutuhan sehari-hari masyarakat dapatmenjadi solusi untuk memenuhi kebutuhan-kebutuhan tersebut karena letak minimarket yang biasanya strategis serta produk yang dijual biasanya lengkap dan memudahkan konsumen untuk mencari produk yang diinginkan. Adapun contoh minimarket yang beroperasi di Indonesia adalah Alfamart. Alfamart merupakan minimarket yang menyediakan kebutuhan sehari-hari bagi masyarakat. Perlindungan hukum terhadap konsumen terkait ketidakjujuran karyawan pada struk belanja Alfamart di Kota Makassar menunjukkan bahwa perlindungan hukum yang dilakukan adalah dengan penyelesaian mediasi oleh BPSK atau di luar pengadilan hal ini ditempuh karena ada itikad baik dari pelaku usaha dengan meminta maaf secara langsung kepada konsumen, serta konsumen memilih menyelesaikan masalahnya melalui luar pengadilan karena menganggap bahwa jalur tersebut lebih memudahkan terlebih lagi konsumen belum sepenuhnya memahami hak-haknya yang telah diatur oleh UUPK sesuai dengan Nomor 8 tahun 1999 tentang Perlindungan Konsumen dalam pasal 4 (b). Serta Pertanggungjawaban karyawan terkait ketidakjujuran pada struk belanja Alfamart di Kota Makassar menunjukkan bahwa pertanggung jawaban yang diberikan adalah diselesaikan dengan cara musyawarah antara pihak Alfamart dan konsumen yang dirugikan, dan Alfamart selaku pelaku usaha memberi permohonon maaf kepada konsumen yang telah dirugikan haknya yang di atur dalam UUPK.</p> Sri Lestari Poernomo Copyright (c) 2023-12-18 2023-12-18 208 217 10.24252/ Implementation of the Job Creation Law on the Supervisory Function of Foreign Workers by the Manpower and Transmigration Service <p>The phenomenon of the high number of foreign workers (TKA), which is increasing every year in Indonesia, especially in the Central Sulawesi region, of course, means that the supervisory function carried out by the Central Sulawesi Province Manpower and Transmigration Service will be increasingly strict. However, since the existence of the Job Creation Law, employment agencies have changed the supervisory function of TKA. The research aims to analyze the role of the employment service in carrying out the supervisory function of foreign workers entering the Central Sulawesi region after the existence of the Job Creation Law. The research method used in this research is Normative Juridical research, which will examine the role of the employment department's supervisory function from changed aspects of the Job Creation Law. To examine how the law should apply. where based on cases in the field, researchs try to analyze facts and also applicable legislation. The research results show that the supervisory function of the Manpower Service after the existence of the Job Creation Law still provides a mandate similar to the Manpower Law. However, in its implementation, as an institution appointed by the state that has the task and function of issuing IMTA (Permits to Employ Foreign Workers), it has now been revoked by the Job Creation Law. Dampak negatif dari perubahan iklim sangat luas, mulai dari dampak sosial, ekonomi, hingga sumber daya alam. Penelitian ini mengkaji urgensi pembentukan Undang-Undang (UU) Pengelolaan Perubahan Iklim di Indonesia dari aspek filosofis, sosiologis, dan yuridis serta studi komparatif hukum perubahan iklim Indonesia dengan negara lain, yaitu Meksiko dan Korea Selatan. Penelitian ini diklasifikasikan sebagai penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan komparatif (comparative approach). Hasil dari penelitian ini menunjukan bahwa Indonesia belum memiliki kerangka kebijakan yang jelas dan terukur. Sejatinya, pengaturan terkait dengan perubahan iklim telah diatur dalam beberapa peraturan. Namun demikian, peraturan-peraturan tersebut masih bersifat sektoral. Lebih lanjut, peraturan-peraturan terkait dengan perubahan iklim yang telah ada di Indonesia masih belum merujuk pada sebuah peraturan induk adaptasi perubahan iklim yang memiliki daya jangka lebih luas dan panjang. Selain itu, peraturan-peraturan tersebut juga belum terintegrasi dengan setiap kebijakan pembangunan nasional. Oleh karena itu, UU Pengelolaan Perubahan Iklim diyakini menjadi sebuah peraturan induk serta kerangka kebijakan yang jelas dan terukur berkaitan dengan pengelolaan perubahan iklim. This has prompted law enforcement agencies to begin drafting and enforcing restorative justice policies in the criminal case settlement process. The purpose of this research is to analyze the working process of restorative justice policies through their implementation practices in each institution that focuses on various criminal justice institutions in Pontianak City. This study will describe the factors that influence the process of working in restorative justice by elaborating on the paradigm of law enforcement officers, policies at their institutions, and their experiences and practices. The method used is normative-empirical legal research as research on law enforcement in concreto. Although the paradigm of punishment has shifted towards a restorative paradigm, the findings in the field showed frequent obstacles. First, cross-sectoral regulatory factors that regulate restorative justice mechanisms with different mechanisms. Second, the weak integration of the criminal justice system as seen in practice between the Pontianak Police and the Pontianak District Attorney Office has not shown the integration of the criminal justice system in the corridor of enforcing the principle of functional differentiation. Third, the factor of criminal law policy is overcriminalistic so it is still overshadowed by the retributive and punitive colonial paradigm. Fourth, factor in the small period of time in the prosecutor's office due to tiered assessments within the structural corridors of leadership. Fadhil Copyright (c) 2023-12-20 2023-12-20 246 263 10.24252/ Putusan Nihil: Mengukur Eksistensi dan Validitas dalam Perspektif Ronald Dworkin <p>Penerapan "putusan nihil" oleh hakim di Indonesia menciptakan ketidakpastian hukum dan moralitas dalam pengadilan, sebuah permasalahan yang perlu diatasi dengan pendekatan yang lebih komprehensif daripada mengandalkan kepastian hukum semata. Dalam konteks ini, prinsip-prinsip filosofis yang lebih luas seperti yang disampaikan oleh Dworkin menjadi relevan. Penelitian ini mengkaji sudut pandang filasafat hukum dalam eksistensi putusan nihil. Di satu sisi, sebagai produk interpretatif kewenangan hakim, putusan nihil dikaji melalui pemaparan filosofis milik Dworkin. Penelitian ini mengevaluasi putusan nihil dengan memeriksa dasar hukumnya dan menggunakan pendekatan peraturan perundang-undangan serta konseptual. Selain itu, penelitian ini mengkaji konsep hukum interpretatif dalam hukum civil law dan memanfaatkan konsep filsafat hukum Ronald Dworkin. Studi ini bertujuan untuk menganalisis eksistensi putusan nihil dalam kerangka hukum sipil serta menguji validitasnya dengan konsep Ronald Dworkin. Eksistensi putusan nihil berasal dari ketidakmampuan sistem hukum Indonesia dalam menangani permasalahan teknis. Kewenangan interpretatif hakim menjadi solusi, yang lambat laun menjadi praktek lazim. Hal ini menciptakan paradoks antara karakteristik civil law dan common law di Indonesia. Ketidakpastian muncul dalam penerapan hukum dan pertimbangan etika dalam hukuman pemidanaan yang adil, menimbulkan dilema prioritas di mana putusan nihil sering kali lebih mengutamakan kepastian hukum daripada kebenaran materiil. Penelitian ini menemukan putusan nihil sebagai jawaban dari celah sistemik sistem hukum Indonesia yang berkarakter <em>civil law</em>. Dalam sudut pandang teori Dworkin, putusan nihil menjadi suatu dilema prioritas antara kepastian hukum dalam system hukum <em>civil law,</em> dengan kebenaran materiil. Penelitian ini merupakan jenis penelitian yuridis normatif, dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Sedangkan untuk metode analisis data yang digunakan adalah metode deskriptif, metode evaluatif, dan metode Argumentatif. Hasil dari penelitian ini menerangkan bahwa kebijakan hukum pidana dalam pertanggungjawaban pidana oleh korporasi di Indonesia lahir dari adanya perbuatan melawan hukum a criminal act <em>(actus reus)</em> dan terpunihinya unsur kesalahan a criminal intent <em>(mens rea)</em> sehingga dari segi objektif terhadap perbuatan yang dinyatakan sebagai tindak pidana yang berlaku dan secara subjektif kepada korporasi sebagai pelaku tindak pidana yang memenuhi persyaratan untuk dapat dikenai pidana karena perbuatannya. Serta penerapan sanksi pidana terhadap korporasi yang melakukan tindak pidana korupsi dalam hukum positif di Indonesia diatur dalam ketentuan Pasal 2 dan Pasal 20 UU No. 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, yang memberikan pemahaman bahwa pertanggungjawaban pengganti dapat diterapkan jika masih dalam kewenangan pimpinan korporasi serta mengatur penerapan pidana pokok hanya dapat diganti dengan pidana denda serta pidana tambahan 1/3.</p> <p><strong><em>Keywords: Korporasi; Korupsi;&nbsp; Pertanggungjawaban Pidana</em></strong></p> Sofiatul Istiqomah Abdul Rokhim Diyan Isnaeni Copyright (c) 2023-12-22 2023-12-22 278 297 10.24252/ Corruption Prevention of Village Funds to Realize Anti-Corruption Village <p><strong>Abstract</strong></p> <p>This paper aims to describe and analyze how the form of corruption prevention of village funds can ideally be carried out to realize an anti-corruption village. This paper uses a normative type of research. The approach used in this paper is a conceptual approach (conceptual approach) and an analytical approach (analytical approach). The discussion in the paper presents that so far the eradication of corruption has focused more on the downstream region by relying on criminal legal means. the eradication of corruption should ideally be pursued optimally in the most upstream areas, namely prevention areas. This includes efforts to prevent corruption of village funds, which have often become "soft food" for irresponsible village government elements and village officials. For this reason, efforts that should be done include. First, seek community participation and active role in the discussion, management, and use of village funds; second, strengthening governance to prevent corrupt practices; third, strengthening supervision, especially regarding village governance; fourth, strengthening the quality of public services to gain full trust from the public and provide feedback instruments to determine public satisfaction with the performance performed; Fifth, strive for the empowerment of local wisdom that applies in the village, such as the role of customary law or local culture and encourage the involvement of various elements such as religious leaders, traditional leaders, community leaders, youth communities.</p> <p><strong><em>Keywords: </em><em>Corruption Prevention; Village Fund; Anti-corruption</em></strong></p> Judy Marria Saimima Juanrico A.S. Kerumitan itu ditengarai bersumber dari sistem multi partai yang digunakan di Indonesia di tengah penggunaan sistem presidensial yang berimbas pada efektifitas kabinet pemerintahan. Penelitian ini untuk menjawab persoalan bagaimana membentuk kabinet yang efektif di tengah sistem presidensial multi partai di Indonesia. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan kasus dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pembentukan kabinet harus diorientasikan pada penguatan posisi presiden di parlemen dan efektifitas kinerja kabinet. Untuk itu dapat dilakukan penataan kabinet dengan mempertimbangkan aspek politik, aspek strategis, aspek teknokratik, dan aspek publik dengan pendekatan proporsionalitas. Penataan kabinet juga perlu dibarengi dengan penataan desain koalisi dengan perhatian pada tiga sektor utama, yaitu penguatan basis koalisi, pengaturan kelembagaan koalisi, dan kontrak politik beserta pengaturan mekanisme internal koalisi. Koalisi yang ideal di tengah sistem presidensial multi partai adalah koalisi yang berbasiskan pada ideologi, cita dan visi untuk membangun bangsa dan negara dalam jangka panjang, sehingga dapat menguatkan sistem presidensial dan berkontribusi positif pada efektifitas dan stabilitas pemerintahan yang pada gilirannya dapat mendorong efektifitas kerja kabinet.&nbsp;</p> <p><strong><em>Kata Kunci: Pembentukan Kabinet; Koalisi; Sistem Presidensial; Multi Partai</em></strong></p> Lutfil Ansori Copyright (c) 2023-12-25 2023-12-25 316 334 10.24252/ Policy Analysis of Civil Servant Mutation on the Needs of Local Government Organizations Based on BKN Regulation No. 5 of 2019 <p><strong>Abstract</strong></p> <p>The implementation of the civil servant mutation policy in the context of the needs of regional government organizations in Gowa Regency is a strategic action carried out by the regional government to transfer employees according to the needs of certain units or departments. Thus, the goal to be achieved is to increase the efficiency and effectiveness of public services by placing employees in positions that suit their abilities and competencies. The research used is field research. This research uses qualitative analysis, intending to provide a systematic description of a phenomenon, symptoms and conditions that occur as well as explaining precisely the conditions that are related to the variables studied. The resulting data shows that the civil servant mutation process must be enforced with strong legal protection, which ensures that all stages of mutation take place fairly, openly and in accordance with applicable regulations.
