Legal Protection for Banking in Financing and Repayment Schemes of Koperasi Desa Merah Putih Through Village Funds

This research examines the issue of legal protection for the banking sector within the financing scheme of the Koperasi Desa (KDMP) under Minister of Finance Regulation No. 15 of 2026. The problem arises from the use of Village Funds as an instrument for credit repayment, which creates a hybridization between private and public law regimes and potentially threatens banking stability and state finances. This study analyzes whether the KDMP financing scheme fulfils the principles of legal protection for banks and formulates an ideal model of legal protection against state financial risks. The research employs normative legal research. Legal materials are analyzed qualitatively through systematic interpretation of regulations, legal doctrines, and theories related to banking, contract, and security law. The findings reveal that regulation contains normative gaps concerning credit agreements, collateral, and risk management, thereby necessitating sectoral regulations to ensure legal certainty and legal protection for the banking sector.
