PERTANGGUNGJAWABAN PIDANA BAGI PELAKU MONEY POLITICS DALAM PEMILIHAN BUPATI TAHUN 2024

Abstrak
Pemilihan kepala daerah merupakan bagian penting dari proses demokrasi di Indonesia. Namun, praktik politik uang (money politics) masih menjadi persoalan serius yang mengancam integritas pemilu. Salah satu aturan yang diatur dalam perundang-undangan adalah larangan menjanjikan atau memberikan uang atau materi lainnya kepada peserta kampanye. Penelitian ini membahas implementasi aturan tersebut dalam konteks pemilihan Bupati, dengan menyoroti efektivitas pengawasan serta kendala yang dihadapi di lapangan. Metode yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dengan pengumpulan data melalui analisis teoritis tentang aspek-aspek hukum, termasuk prinsip-prinsip hukum, konsepsi hukum, pandangan, dan doktrin-doktrin hukum. Metode ini menggunakan data sekunder seperti asas, kaidah, norma, dan aturan hukum yang terdapat dalam peraturan perundang-undangan dan dokumen hukum lainnya. Hasil penelitian menunjukkan bahwa meskipun regulasi telah dibuat, implementasi di lapangan masih menghadapi berbagai hambatan, seperti lemahnya penegakan hukum, minimnya partisipasi masyarakat dalam pengawasan, dan adanya celah dalam pelaporan pelanggaran. Sebagai kesimpulan, dibutuhkan peningkatan kapasitas lembaga pengawas serta edukasi politik kepada masyarakat agar praktik politik uang dapat ditekan. Saran yang dapat diberikan adalah perlunya sistem pelaporan yang lebih transparan dan perlindungan bagi pelapor pelanggaran sebagai upaya memperkuat penerapan aturan tersebut.

Abstract
Regional head elections are an important part of the democratic process in Indonesia. However, the practice of money politics is still a serious problem that threatens the integrity of the election. One of the rules stipulated in the legislation is the prohibition on promising or giving money or other materials to campaign participants. This study discusses the implementation of this rule in the context of the Regent election, highlighting the effectiveness of supervision and the obstacles faced in the field. The method used in this study is a normative legal approach with data collection through theoretical analysis of legal aspects, including legal principles, legal concepts, views, and legal doctrines. This method uses secondary data such as principles, rules, norms, and legal rules contained in laws and other legal documents. The results of the study show that although regulations have been made, implementation in the field still faces various obstacles, such as weak law enforcement, minimal public participation in supervision, and gaps in reporting violations. In conclusion, it is necessary to increase the capacity of supervisory institutions and provide political education to the public so that the practice of money politics can be suppressed. The suggestion that can be given is the need for a more transparent reporting system and protection for whistleblowers as an effort to strengthen the implementation of these regulations.
