PENEGAKAN HUKUM TANGGUNG JAWAB PIDANA NOTARIS DALAM KEWENANGAN SEBAGAI PPAT DI POLDA SULAWESI SELATAN

Abstrak
Berdasarkan Undang-Undang Jabatan Notaris diatur hanya sanksi Akta terdegradasi menjadi akta di bawah tangan, batal demi hukum dan sanksi administrasi. Berdasarkan permasalahan tersebut menimbulkan ketidakpastian hukum terkait pengaturan sanksi pidana notaris yang melakukan suatu pelanggaran hukum dalam UUJN dalam penelitian tersebut yaitu : 1. Bagaimanakah pelaksanaan penegakan hukum Tanggung jawab pidana notaris dalam kewenangan sebagai PPAT di POLDA Sulawesi Selatan? 2. Apakah Faktor-faktor yang mempengaruhi implementasi penegakan hukum tanggung jawab pidana notaris dalam kewenangan sebagai PPAT di POLDA Sulawesi Selatan? Penelitian ini merupakan penelitian hukum empiris (empirical research), Jenis pendekatan yaitu 1. Pendekatan Perundang-undangan, 2. Pendekatan Konseptual dan 3. Pendekatan Kasus. Lokasi penelitian adalah di Kantor Kepolisian Daerah (POLDA) Sulawesi Selatan. Sumber Data Hukum yaitu Sumber Data Hukum primer, sekunder dan tersier. Teknik Pengumpulan Data Hukum yaitu Studi Dokumentasi dan Wawancara. Serta Teknik Analisis Data Hukum adalah Kualitatif Deskriptif. Hasil penelitian menunjukkan sebagai berikut: 1. Pelaksanaan penegakan hukum Tanggung jawab pidana notaris dalam kewenangan sebagai PPAT di POLDA Sulawesi Selatan adalah belum dilaksanakan secara efektif karena belum adanya pengaturan hukum yang mengatur secara rinci dalam Undang-undang Jabatan Notaris terkait sanksi pidana bagi notaris yang melakukan suatu pelanggaran hukum. 2. Faktor-faktor yang mempengaruhi implementasi penegakan hukum tanggung jawab pidana notaris dalam kewenangan sebagai PPAT di POLDA Sulawesi Selatan adalah sebagai berikut yaitu: a. Faktor Struktur Hukum, b. Faktor Substansi Hukum dan c. Faktor Sarana dan Fasilitas.

Abstract
Based on the Notary Law, only sanctions are regulated for a deed to be degraded to a deed under hand, null and void by law and administrative sanctions. Based on these problems, there is legal uncertainty regarding the regulation of criminal sanctions for notaries who commit a violation of the law in the UUJN in the study, namely: 1. How is the implementation of the law enforcement of the criminal responsibility of notaries in their authority as PPAT at the South Sulawesi Regional Police? 2. What are the factors that influence the implementation of the law enforcement of the criminal responsibility of notaries in their authority as PPAT at the South Sulawesi Regional Police? This research is an empirical legal research, the types of approaches are 1. Legislation Approach, 2. Conceptual Approach and 3. Case Approach. The location of the research is at the South Sulawesi Regional Police Office (POLDA). Legal Data Sources are primary, secondary and tertiary Legal Data Sources. Legal Data Collection Techniques are Documentation Study and Interviews. And the Legal Data Analysis Technique is Qualitative Descriptive. The results of the study indicate the following: 1. The implementation of the law enforcement of the criminal responsibility of notaries in their authority as PPAT at the South Sulawesi Regional Police has not been implemented effectively because there are no legal regulations that regulate in detail in the Notary Law regarding criminal sanctions for notaries who commit a violation of the law. 2. The factors that influence the implementation of the law enforcement of the criminal responsibility of notaries in their authority as PPAT at the South Sulawesi Regional Police are as follows: a. Legal Structure Factor, b. Legal Substance Factor and c. Facilities and Infrastructure Factor.
