ANTARA UNDANG UNDANG DAN REALITA : PENEGAKAN HUKUM DALAM KASUS KEKERASAN RUMAH TANGGA

Abstrak
Kekerasan dalam rumah tangga (KDRT) adalah isu yang telah lama ada dan tetap menjadi permasalahan utama. yang masih menjadi persoalan serius dalam masyarakat Indonesia. Meskipun telah ada payung Peraturan hukum yang dimuat dalam Undang-Undang No. 23 Tahun 2004 mengenai tindakan untuk mengakhiri kekerasan domestik menyumbangkan jaminan perlindungan kepada para korban, khususnya perempuan, masih belum optimal. Faktor penyebab KDRT meliputi kecemburuan, masalah ekonomi, dan kurangnya pemahaman hukum. Penanganan KDRT memerlukan peran aktif Pemerintah, pihak berwenang, dan komunitas untuk melakukan pencegahan dan menawarkan perlindungan berdasarkan ketentuan hukum yang efektif kepada korban. Studi ini mengaplikasikan pendekatan yuridis empiris, atau sering diistilahkan triangulasi metode, yaitu metode penelitian hukum yang menggabungkan antara pendekatan normatif yaitu hukum pada saat teoritis (sebagai law in the books) dengan pendekatan empiris, yaitu hukum pada saat praktik (sebagai lawin action). Metode ini memungkinkan peneliti untuk melihat dan membandingkan perbedaan diantara peraturan hukum berbelaku dengan praktek di masyarakat.

Abstract
Domestic violence (DV) is an issue that has long existed and remains a major problem that continues to be a serious concern in Indonesian society. Although there is a legal framework provided by Law No. 23 of 2004 regarding actions to end domestic violence that offers protection guarantees to victims, especially women, it is still not optimal. The causes of domestic violence include jealousy, economic issues, and a lack of legal understanding. Addressing domestic violence requires the active role of the Government, authorities, and the community to prevent it and to provide effective legal protections to the victims. This study applies an empirical legal approach, often referred to as method triangulation, which is a legal research method that combines normative approaches, law in theoretical terms (as law in the books), with an empirical approach, law in practice (as law in action). This method allows researchers to observe and compare the differences between applicable legal regulations and social practices.
