MEKANISME PENYELESAIAN SENGKETA NON LITIGASI DENGAN PROSES ARBITRASE

Abstrak
Di Indonesia proses penyelesaian sengketa antar para pihak dapat dilakukan melalui dua cara yaitu melalui prosedur jalur litigasi (pengadilan) atau melalui jalur non-litigasi (penyelesaian sengketa diluar pengadilan) contohnya seperti mediasi, konsiliasi, negosiasi, konsultasi, valuasi ahli, dan arbitrase. Berkaitan dengan arbitrase sebagai salah satu jalur dalam penyelesaian sengketa diluar pengadilan sebenarnya sudah lama ada dan telah dipraktekkan selama berabad-abad. Selain Negara asing, Indonesai pun telah mengenal arbitrase sebagai salah satu alternatif penyelesaian sengketa publik melalui jalur non-litigasi. Dalam penyelsaian sengketa melalui arbitrase, pihak yang bersengketa dapat memilih lembaga arbitrase untuk menyelesaikan sengketanya yang terdiri atas arbitrase ad hoc dan arbitrase institusional. penyelesaian sengketa melalui arbitrase dapat dilakukan dengan klausula arbitrase, yaitu yang berbentuk pactum de compromittendo dan yang berbentuk acta kompromi. kemudian arbitrase diciptakan dari klausul yang mereka ambil dalam bentuk kontrak yang telah mereka setujui. Dengan demikian, para pihak yang termasuk dalam kontrak tersebut harus mengikuti/melakukan segala sesuatu yang telah diperjanjikan dalam kontrak tersebut dikarenakan kekuatan hukum dari putusan arbitrase bersifat final dan mengikat, tetapi pengakuan dan eksekusi putusannya tetap harus diterapkan ke pengadilan negeri.

Abstract
In Indonesia, the process of resolving disputes between parties can be carried out in two ways, namely through litigation (court) procedures or through non-litigation (dispute resolution outside the court) for example mediation, conciliation, negotiation, consultation, expert valuation, and arbitration. Regarding arbitration as a way to resolve disputes outside the court, it has actually existed for a long time and has been practiced for centuries. Apart from foreign countries, Indonesia has also recognized arbitration as an alternative to resolving public disputes through non-litigation channels. In resolving disputes through arbitration, disputing parties may choose an arbitration institution to resolve their dispute which consists of ad hoc arbitration and institutional arbitration. Dispute resolution through arbitration can be carried out with an arbitration clause, namely in the form of a pactum de compromittendo and in the form of a compromise act. then the arbitration was created from the clauses they took in the form of a contract they had agreed to. Thus, the parties included in the contract must follow/do everything that has been agreed in the contract because the legal force of the arbitral award is final and binding, but the recognition and execution of the decision must still be applied to the district court.
