Abstrak
Paten merupakan hak ekslusif yang diberikan oleh negara kepada inventor atas hasil invensinya dibidang teknologi, yang untuk selama waktu tertentu melaksanakan sendiri hasil invensinya tersebut atau memberikan persetujuan kepada pihak lain untuk melaksanakannya. Adapun tujuan dari penelitian ini adalah untuk mengetahui aturan hukum tentang paten dan untuk mengetahui penerapan sanksi terhadap pelanggar paten. Dalam menjawab permasalahan tersebut, penulis menggunakan pendekatan yuridis dan sosiologis terhadap permasalahan dalam tulisan ini. Penelitian ini tergolong library research, data dikumpulkan dengan mengutip dan menganalisis literatur yang representatif dan mempunyai relevansi dengan masalah yang dibahas, kemudian menguraikan dan menyimpulkannya. Berdasarkan hasil penelitian, bahwa dengan adanya Undang-Undang No. 14 Tahun 2001 tentang paten para inventor tidak perlu khawatir lagi invensinya akan disalahgunakan oleh pihak lain karena invensi kita akan dilindungi oleh negara bahkan dunia internasional. Namun terdapat beberapa problematika yang masih menjadi masalah serius dan perlu mendapat perhatian khusus yaitu dalam penerapan sanksi dalam Undang-Undang ini, dimana terdapat sanksi yang tumpang tindih dan kurangnya kesadaran masyarakat untuk mempatenkan atau mendaftarkan hasil penemuannya. Diharapkan ini bisa menjadi perhatian bagi pemerintah dan kesadaran kepada masyarakat untuk mempatenkan hasil penemuannya agar tidak terjadi sengketa dikemudian hari.

Abstract
A patent is an exclusive right granted by the state to an inventor for the results of his invention in the field of technology, which for a certain period of time carries out the results of his invention himself or gives permission to another party to carry it out. The purpose of this study is to find out the legal regulations on patents and to find out the application of sanctions against patent violators. In answering these problems, the author uses a legal and sociological approach to the problems in this paper. This research is classified as library research, data is collected by citing and analyzing representative literature that is relevant to the problem being discussed, then describing and concluding it. Based on the results of the study, with the existence of Law No. 14 of 2001 concerning patents, inventors no longer need to worry that their inventions will be misused by other parties because our inventions will be protected by the state and even the international world. However, there are several problems that are still serious problems and need special attention, namely in the application of sanctions in this Law, where there are overlapping sanctions and a lack of public awareness to patent or register their inventions. It is hoped that this can be a concern for the government and raise awareness among the public to patent their inventions so that disputes do not arise in the future.
