ANALISIS YURIDIS TINDAK PIDANA PENGGELAPAN DI TEMPAT KERJA BERDASARKAN PUTUSAN NOMOR 96/PID.B/2024/PN PBL

Abstrak
Tindak pidana penggelapan kerap terjadi di lingkungan kerja akibat penyalahgunaan kepercayaan. Penelitian ini menganalisis penerapan Pasal 372 KUHP dalam kasus penggelapan oleh sopir di CV Exotic Java Adventure berdasarkan Putusan Nomor 96/Pid.B/2024/PN Pbl. Dengan pendekatan yuridis normatif dan studi kasus, ditemukan bahwa unsur penggelapan terpenuhi secara hukum. Terdakwa terbukti menggelapkan uang setoran sebesar Rp78.100.000 untuk berjudi online dan dijatuhi hukuman dua tahun penjara. Meskipun penegakan hukum telah dilakukan, efek jera dan perlindungan terhadap korban dinilai belum maksimal. Penelitian ini menekankan pentingnya pencegahan melalui pengawasan internal, edukasi hukum, dan sistem kerja berbasis akuntabilitas sebagai upaya mengurangi penggelapan di tempat kerja, khususnya dalam era digital.

Abstract
Embezzlement often occurs in the workplace due to abuse of trust. This study analyzes the application of Article 372 of the Criminal Code in a case of embezzlement by a driver at CV Exotic Java Adventure based on Decision Number 96/Pid.B/2024/PN Pbl. Using a normative juridical approach and case study, it was found that the elements of embezzlement were legally fulfilled. The defendant was found guilty of embezzling Rp78,100,000 in deposits for online gambling and was sentenced to two years in prison. Although law enforcement has been carried out, the deterrent effect and protection for victims are considered less than optimal. This study emphasizes the importance of prevention through internal supervision, legal education, and an accountability-based work system as an effort to reduce embezzlement in the workplace, especially in the digital era.
