Penelitian ini bertujuan untuk mengetahui dan memahami bentuk perlindungan investor terhadap penghalang aktivitas pertambang. Penelitian ini menggunakan penelitian normatif. Hasil penelitian ini adalah Tindak pidana dibidang pertambangan mineral dan batu bara terdapat subjek hukum dari sekelompok masyarakat yang mengatasnamakan suatu organisasi paguyuban yang bernama Pambers telah dengan sengaja menghalang- halangi aktifitas investor pertambangan dengan dalil wilayah pertambangan PT. ST Nickel Resources merupakan wilayah atau tanah yang dikuasai oleh sekelompok masyarakat sebelum adanya ketentuan undang-undang nomor 4 tahun 2009 tentang pertambangan mineral dan batu bara, kemudian terjadinya konflik antara investor dengan masyarakat secara premanisme menghalang-halangi aktifitas penambangan, melakukan aksi unjuk rasa (demonstrasi) dan membuat palang/pagar serta menghentikan kegiatan alat berat yang bekerja di wilayah IUP-OP PT. ST Nickel Resources, sehingga berakibat menimbulkan kerugian bagi investor.

Abstract

This study aims to determine and understand the form of investor protection against obstruction of mining activities. This study uses normative research. The results of this study are criminal acts in the field of mineral and coal mining, there are legal subjects from a group of people who, on behalf of a community organization called Pambers, have deliberately obstructed the activities of mining investors on the grounds that the mining area of ​​PT. ST Nickel Resources is an area or land controlled by a group of people before the provisions of law number 4 of 2009 concerning mineral and coal mining, then a conflict occurs between investors and the community in a thuggish manner obstructing mining activities, conducting demonstrations and making barriers/fences and stopping the activities of heavy equipment working in the IUP-OP area of ​​PT. ST Nickel Resources, resulting in losses for investors.
