PERLINDUNGAN HUKUM TERHADAP ANAK BALITA KORBAN PENGANIAYAAN DALAM LINGKUNGAN KELUARGA

Abstrak
Fenomena meningkatnya kasus penganiayaan terhadap anak balita dalam lingkungan keluarga menjadi perhatian serius dalam konteks perlindungan hukum anak di Indonesia. Anak balita, sebagai kelompok usia paling rentan, sering kali menjadi korban kekerasan fisik maupun psikis yang dilakukan oleh orang tua atau pengasuh terdekat. Penelitian ini bertujuan untuk mengkaji secara normatif bentuk perlindungan hukum yang tersedia bagi anak balita korban penganiayaan dalam lingkungan keluarga serta mengidentifikasi upaya hukum yang dapat dilakukan untuk menanggulangi tindak pidana tersebut. Berdasarkan metode penelitian yuridis normatif, penelitian ini menelaah berbagai peraturan perundang-undangan, seperti Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak dan Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga. Pembahasan menunjukkan bahwa perlindungan hukum terhadap anak balita mencakup upaya preventif dan represif yang harus didukung oleh penegakan hukum yang konsisten, edukasi masyarakat, serta peran aktif lembaga perlindungan anak. Implementasi hukum yang masih lemah menjadi tantangan utama dalam memberikan keadilan bagi korban. Selain itu, kesadaran hukum masyarakat yang rendah serta stigma sosial turut menjadi penghambat dalam proses pelaporan dan penyelesaian kasus. Penelitian ini menyimpulkan perlunya penguatan sistem hukum yang berpihak pada korban anak, serta peningkatan peran keluarga, masyarakat dan negara dalam menciptakan lingkungan yang aman bagi tumbuh kembang anak balita.

Abstract
The rising phenomenon of abuse against toddlers within the family environment has become a critical concern in the context of child legal protection in Indonesian. Toddlers, as the most vulnerable age group, are frequently subjected to physical and psychological abuse by parents or close caregive. This study aims to examine, from a normative legal perspective, the forms of legal protection available to toddlers who are victims of abuse in the family and to identify the legal efforts that can be taken to address such criminal acts. Using a normative juridical research method, this study analyzes various legal regulations, such as Law Number 35 of 2014 concerning Child Protection and Law Number 23 of 2004 concerning the Elimination of Domestic Violence. The discussion reveals that legal protection for abused toddlers involves both preventive and repressive efforts, wich must be supported by consistent law enforcement, public legal education, and the active role child protection institutions. Weak law implementation remains a major challenge in providing justice for victims. Moreover, low public legal awareness and prevailing social stigma hinder the reporting and resolution of abuse cases. This research concludes that a strengthened legal system that prioritizes child victims is urgently needed, along with enhanced roles of the family, society, and the state in creating a safe and nurturing enviroment for toddler development.
