URGENSI SKEMA PENJAMINAN SIMPANAN SYARIAH DI INDONESIA: KRITIK ATAS KETIMPANGAN REGULASI DALAM SISTEM KEUANGAN GANDA

Abstrak
Sistem keuangan Indonesia menganut dual banking system, namun skema penjaminan simpanan yang berlaku masih seragam dan bercorak konvensional. Ketidaksesuaian ini menimbulkan ketimpangan regulasi terhadap perbankan syariah, baik secara normatif, struktural, maupun kelembagaan. Fokus penelitian ini adalah ketimpangan regulasi dalam skema penjaminan simpanan di Indonesia serta mendesakkan urgensi pembentukan skema penjaminan syariah yang mandiri. Tujuan utama penelitian ini adalah untuk mengidentifikasi bentuk-bentuk ketimpangan regulatif yang dihadapi bank syariah, sekaligus menawarkan landasan normatif dan kebijakan untuk pembentukan sistem penjaminan syariah yang sesuai prinsip-prinsip syariah. Penelitian ini menggunakan pendekatan yuridis-normatif dengan metode kualitatif berbasis studi kepustakaan. Hasil penelitian menunjukkan bahwa terdapat empat bentuk utama ketimpangan, yakni ketimpangan norma, struktur kelembagaan, pengelolaan dana, dan kesiapan pasca-spin-off UUS. Ketimpangan ini lahir dari pendekatan keseragaman hukum yang mengabaikan karakteristik substantif sistem keuangan syariah. Oleh karena itu, pembentukan skema penjaminan simpanan syariah yang mandiri dan sesuai prinsip fikih merupakan keharusan untuk menjamin keadilan hukum, kepastian kelembagaan, serta keberlanjutan sistem keuangan ganda di Indonesia.

Abstract
Indonesia adopts a dual banking system, allowing conventional and Islamic banks to operate side by side. However, the existing deposit insurance scheme remains uniform and conventionally oriented. This misalignment has resulted in regulatory disparities affecting Islamic banking in normative, structural, and institutional aspects. This study focuses on examining the regulatory asymmetries within Indonesia’s deposit insurance system and emphasizes the urgency of establishing a distinct Islamic deposit insurance scheme. The primary objective is to identify the forms of regulatory imbalance faced by Islamic banks and to propose normative and policy frameworks aligned with Islamic legal principles.
Employing a juridical-normative approach and qualitative library research, the study identifies four main areas of disparity: legal norms, institutional structure, fund management, and post–spin-off preparedness of Islamic banking units. These disparities stem from a one-size-fits-all legal framework that overlooks the unique characteristics of Islamic financial systems. Therefore, establishing an independent and sharia-compliant deposit insurance scheme is imperative to ensure legal justice, institutional certainty, and the sustainability of Indonesia’s dual financial system.
