TINJAUAN HUKUM KEWENANGAN OMBUDSMAN RI DALAM PENYELENGGARAAN PELAYANAN PUBLIK BIDANG KESEHATAN DI KOTA MAKASSAR

Abstrak
Penyelenggara pelayanan publik pada masa ini menjadi titik sentral untuk mengukur tata tertib hukum administrasi dalam rangka mewujudkan tujuan negara untuk memajukan kesejahteraan rakyat. Pelayanan public di bidang Kesehatan merupakan salah satu hak dasar warga negara yang dijamin oleh konstitusi dan diatur dalam berbagai peraturan perundang-undangan. Ombudsman RI memiliki kewenangan untuk mengawasi penyelenggaraan pelayanan public agar bebas dari praktik maladministrasi, termasuk di sector Kesehatan.penelitian ini betujuan untuk menganilisis kewenangan Ombudsmandalam mengawasi pelayanan public di bidang Kesehatan di Kota Makassar.metode penelitian yang digunakan adalh penelitian hukum normtatif dengan pendekatan perundang-undangan dan pendekatan konseptual, yang didukung oleh data sekunder berupa peraturan perundang-undangan, literatur hukum, dan dokumen resmi Ombudsman. hasil penelitian menunjukkan bahwa kewenangan Ombudsman diatur secara jelas dalm UU No. 37 Tahun 2008 Tentang Ombudsman RI. Dalam konteks Kota Makassar, pelaksanaan kewenangan tersebut menhadapi tantangan seperti rendahnya pemahaman masyarakat terhadap peran Ombudsman, keterbatasan sumber daya, serta resistensi dari Sebagian penyelenggara layanan Kesehatan. Penelitian ini merekomendasikan penguatan sosialisasi peran Ombudsman, penigkatan kapsitan sumber daya manusia, serta optimalisasi kerja sama dengan instansi Kesehatan untuk menjamin pemenuhan hak masyarakat atas pelayanan Kesehatan yang berkualitas.

Abstract
Public service providers are currently the central point for measuring administrative law enforcement in realizing the state's goal of advancing public welfare. Public services in the health sector are one of the basic rights of citizens guaranteed by the constitution and regulated in various laws and regulations. The Indonesian Ombudsman has the authority to oversee the implementation of public services to ensure they are free from maladministration practices, including in the health sector. This study aims to analyze the Ombudsman's authority in overseeing public services in the health sector in Makassar City. The research method used is normative legal research with a statutory and conceptual approach, supported by secondary data in the form of laws and regulations, legal literature, and official Ombudsman documents. The results show that the Ombudsman's authority is clearly regulated in Law No. 37 of 2008 concerning the Indonesian Ombudsman. In the context of Makassar City, the implementation of this authority faces challenges such as low public understanding of the Ombudsman's role, limited resources, and resistance from some health service providers. This study recommends strengthening the public awareness of the Ombudsman's role, increasing human resource capacity, and optimizing collaboration with health institutions to ensure the fulfillment of the public's right to quality health services.
