Abstrak
Praktik gadai kebun masih menjadi solusi utama masyarakat pedesaan dalam memenuhi kebutuhan ekonomi mendesak, meskipun sering kali menyimpang dari prinsip akad rahn dalam hukum Islam. Penelitian ini bertujuan mendeskripsikan praktik gadai kebun dengan pengelolaan oleh penggadai (rahin) di Desa Talang Baru Bumi Nabung, Kabupaten Lampung Utara, serta menganalisis kesesuaiannya dengan hukum ekonomi syariah. Penelitian menggunakan metode kualitatif lapangan melalui wawancara dengan tiga rahin, dua murtahin, dan seorang tokoh masyarakat, serta dilengkapi dengan studi literatur. Hasil penelitian menunjukkan bahwa rahin tetap mengelola kebun, tetapi hasil panen dibagi dua dengan murtahin, sementara pokok utang tidak berkurang. Kondisi ini menyebabkan rahin menanggung seluruh biaya dan risiko, sedangkan murtahin memperoleh keuntungan tanpa beban. Analisis hukum ekonomi syariah menegaskan bahwa praktik ini menyimpang dari prinsip rahn karena murtahin mengambil manfaat dari barang gadai tanpa akad tambahan yang sah, sehingga berpotensi mengandung riba dan bertentangan dengan maqashid syariah dalam aspek perlindungan harta (hifz al-mal). Penelitian merekomendasikan perlunya edukasi kepada masyarakat, peran aktif tokoh agama dan pemerintah desa, serta penerapan akad alternatif seperti musyarakah atau mudharabah agar transaksi gadai kebun lebih adil dan sesuai syariah.

Abstract
Pawning gardens remains the main solution for rural communities in meeting urgent economic needs. However, this practice often deviates from the principles of rahn contracts in Islamic law. This study aims to describe the practice of mortgage gardens managed by the pawnbroker (rahin) in Talang Baru Bumi Nabung Village, North Lampung Regency. It also analyzes its compliance with sharia economic law. The research uses a qualitative field method through interviews with three rahin, two murtahin, and a community leader. It is supplemented by a literature study. The results show that the rahin continues to manage the garden, but the harvest is divided equally with the murtahin. The principal debt does not decrease. This condition causes the rahin to bear all costs and risks, while the murtahin gains profits without burden. The analysis of Islamic economic law emphasizes that this practice deviates from the principle of rahn. The murtahin benefits from the pawned goods without a valid additional contract. This potentially contains usury and contradicts the maqashid of sharia in the aspect of protecting wealth (hifz al-mal). The research recommends the need for education for the community. It also urges an active role for religious leaders and village governments and suggests implementing alternative contracts such as musyarakah or mudharabah to ensure fairer and sharia-compliant garden pawn transactions.
