STUDI LITERATUR TANAH TERLANTAR SEBAGAI OBJEK REFORMA AGRARIA: ANALISIS NORMATIF TERHADAP KEBIJAKAN PENERTIBAN

ABSTRAK
Penelitian ini mengkaji kedudukan tanah terlantar sebagai objek reforma agraria dalam kerangka hukum agraria nasional Indonesia. Tanah terlantar merupakan permasalahan struktural yang menghambat pemerataan penguasaan dan pemanfaatan tanah, sehingga penanganannya menjadi bagian penting dari pelaksanaan reforma agraria. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Bahan hukum yang digunakan meliputi bahan hukum primer berupa peraturan perundang-undangan, yaitu Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria, Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja, Peraturan Pemerintah Nomor 20 Tahun 2021, Peraturan Pemerintah Nomor 48 Tahun 2025, serta Peraturan Presiden Nomor 62 Tahun 2023, dan bahan hukum sekunder berupa literatur dan jurnal ilmiah di bidang hukum agraria. Hasil penelitian menunjukkan bahwa mekanisme penertiban tanah terlantar diatur secara bertahap melalui tahap identifikasi, peringatan, hingga penetapan sebagai tanah terlantar yang selanjutnya menjadi tanah cadangan umum negara. Tanah tersebut kemudian dapat didistribusikan kembali kepada masyarakat sebagai bagian dari pelaksanaan reforma agraria. Namun demikian, implementasinya masih menghadapi berbagai kendala, baik dari sisi administratif, kapasitas kelembagaan, maupun kesadaran hukum masyarakat. Penelitian ini menyimpulkan bahwa efektivitas penertiban tanah terlantar sebagai instrumen reforma agraria sangat bergantung pada konsistensi regulasi, pengawasan yang ketat, serta sinergi antarlembaga yang terlibat.

ABSTRACT
This study examines the position of abandoned land (tanah terlantar) as an object of agrarian reform within the framework of Indonesian national agrarian law. Abandoned land constitutes a structural problem that hinders equitable land tenure and utilization, making its resolution an essential component of agrarian reform implementation. This study employs a normative legal research method with a statute approach and a conceptual approach. The legal materials used include primary legal materials in the form of legislation, namely Law Number 5 of 1960 on Basic Agrarian Principles, Law Number 11 of 2020 on Job Creation, Government Regulation Number 20 of 2021, Government Regulation Number 48 of 2025, and Presidential Regulation Number 62 of 2023, as well as secondary legal materials consisting of literature and scientific journals in the field of agrarian law. The results of this study indicate that the mechanism for controlling abandoned land is regulated in stages, covering identification, warning, and determination as abandoned land, which subsequently becomes state reserve land. Such land may then be redistributed to the community as part of agrarian reform implementation. Nevertheless, its implementation still faces various challenges, including administrative constraints, limited institutional capacity, and insufficient legal awareness among the public. This study concludes that the effectiveness of abandoned land control as an instrument of agrarian reform depends greatly on regulatory consistency, strict supervision, and inter-agency synergy among the institutions involved.
