PRINSIP FIRST TO FILE DAN PERLINDUNGAN MEREK TERKENAL ASING DI INDONESIA (STUDI KASUS SENGKETA MEREK “PIERRE CARDIN”)

Penelitian ini membahas penerapan prinsip first to file dan perlindungan hukum kepada merek terkenal asing di Indonesia melalui studi kasus sengketa merek Pierre Cardin. Penelitian ini menggunakan metode hukum normative. Hasil penelitian menunjukkan bahwa penerapan prinsip first to file di Indonesia masih cenderung formalistik karena lebih mengutamakan bukti pendaftaran dibandingkan reputasi internasional suatu merek terkenal. Perlindungan hukum terhadap merek terkenal sebenarnya telah diatur dalam UU Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, namun implementasinya belum optimal. Oleh sebab itu, perlunya penerapan hukum yang lebih substantif dengan mempertimbangkan reputasi merek dan unsur itikad baik guna menciptakan kepastian hukum dan keadilan.

Abstract

This study discusses the application of the principle of first to file and legal protection to foreign well-known brands in Indonesia through a case study of Pierre Cardin's trademark dispute. This research uses normative legal methods. The results of the study show that the application of the first-to-file principle in Indonesia still tends to be formalistic because it prioritizes proof of registration over the international reputation of a well-known brand. Legal protection for well-known brands has actually been regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications, but its implementation has not been optimal. Therefore, there is a need for a more substantive application of the law by considering brand reputation and elements of good faith to create legal certainty and justice.
