REKONTRUKSI HUKUM EKONOMI SYARIAH ATAS TREN SLOW TRAVEL DAN KEBIJAKAN OVER-TOURISM GLOBAL KONTEMPORER

Abstrak
Rekonstruksi teori nilai dalam ekonomi syariah menekankan perubahan paradigma dari orientasi pasar menuju pendekatan berbasis Maqāṣid al-Sharī‘ah. Dalam perspektif ini, nilai ekonomi tidak hanya ditentukan oleh permintaan, penawaran, dan daya beli, tetapi juga oleh aspek moral, sosial, dan spiritual yang bertujuan mewujudkan kemaslahatan. Penelitian ini bertujuan menganalisis relevansi pendekatan maqāṣid dalam fenomena slow travel dan over-tourism pada sektor pariwisata kontemporer. Metode yang digunakan adalah penelitian kualitatif dengan pendekatan normatif melalui analisis prinsip-prinsip hukum Islam dan literatur terkait. Hasil penelitian menunjukkan bahwa slow travel sejalan dengan tujuan maqāṣid, terutama dalam menjaga lingkungan, mewujudkan keadilan ekonomi, serta mendorong pola konsumsi yang moderat dan bertanggung jawab. Konsep ini mendukung pariwisata berkelanjutan yang memberikan manfaat lebih merata bagi masyarakat lokal. Sebaliknya, over-tourism bertentangan dengan nilai-nilai syariah karena mengandung unsur berlebihan (isrāf), menimbulkan kerusakan lingkungan (fasād), serta memicu ketimpangan sosial dan ekonomi. Fenomena tersebut berpotensi mengancam tujuan pokok syariah, yaitu perlindungan agama, jiwa, akal, keturunan, dan harta. Oleh karena itu, integrasi Maqāṣid al-Sharī‘ah dalam pengelolaan pariwisata diperlukan untuk mewujudkan sistem ekonomi yang adil, berkelanjutan, dan berorientasi pada tercapainya falāḥ.

Abstract
The reconstruction of value theory in Islamic economics emphasizes a paradigm shift from a market-oriented approach to one based on Maqāṣid al-Sharī‘ah. In this perspective, economic value is determined not only by demand, supply, and purchasing power but also by moral, social, and spiritual dimensions aimed at achieving public welfare (maṣlaḥah). This study aims to analyze the relevance of the maqāṣid approach to the contemporary tourism phenomena of slow travel and over-tourism. The research employs a qualitative method with a normative approach through the analysis of Islamic legal principles and relevant literature. The findings indicate that slow travel is highly consistent with the objectives of maqāṣid, particularly in environmental preservation, economic justice, and responsible consumption. This concept promotes sustainable tourism that distributes benefits more equitably to local communities. In contrast, over-tourism contradicts Islamic values as it involves excessiveness (isrāf), environmental degradation (fasād), and social and economic inequality. Such conditions may threaten the fundamental objectives of Islamic law, namely the protection of religion, life, intellect, lineage, and wealth. Therefore, integrating Maqāṣid al-Sharī‘ah into tourism management is essential for developing an economic system that is just, sustainable, and oriented toward achieving falāḥ.
