Perkembangan perdagangan digital dan social commerce meningkatkan risiko kerugian konsumen akibat produk cacat, informasi yang menyesatkan, maupun praktik usaha yang merugikan. Di sisi lain, pengaturan ganti rugi dalam hukum perlindungan konsumen masih menghadapi persoalan dalam menjamin pemulihan kerugian yang proporsional dengan kerugian aktual yang dialami konsumen. Kondisi ini menimbulkan pertanyaan mengenai sejauh mana mekanisme ganti rugi yang berlaku telah mencerminkan prinsip keadilan korektif. Penelitian ini bertujuan menganalisis kelemahan pengaturan ganti rugi melalui penguatan prinsip strict liability. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pekonseptual. Hasil penelitian menunjukkan bahwa penerapan strict liability yang lebih tegas dan berorientasi pada pemulihan kerugian aktual konsumen dapat mewujudkan keadilan korektif, mengingat efektivitas perlindungan konsumen, serta memberikan kepastian hukum dalam penyelesaian sengeketa konsumen di era perdagangan digital.

Abstract

The growth of digital commerce and social commerce has increased the risk of consumer losses due to defective products, misleading information, and harmful business practices. On the other hand, the provisions for compensation under consumer protection law still face challenges in ensuring that the compensation awarded is proportional to the actual losses suffered by consumers. This situation raises questions regarding the extent to which existing compensation mechanisms reflect the principle of corrective justice. This study aims to analyze the weaknesses in compensation regulations by strengthening the principle of strict liability. The study employs a normative legal research method using legislative and conceptual approaches. The results of the study indicate that a more rigorous application of strict liability, oriented toward the recovery of consumers’ actual losses, can realize corrective justice, given the effectiveness of consumer protection, and provide legal certainty in the resolution of consumer disputes in the era of digital commerce.
