PERLINDUNGAN HUKUM TERHADAP DATA PRIBADI KONSUMEN DALAM TRANSAKSI ELEKTRONIK BERDASARKAN HUKUM POSITIF INDONESIA

Abstrak
Perkembangan transaksi elektronik telah meningkatkan kemudahan masyarakat dalam memperoleh barang dan/atau jasa, tetapi juga meningkatkan risiko penyalahgunaan dan kebocoran data pribadi konsumen. Kondisi tersebut menjadikan perlindungan hukum terhadap data pribadi sebagai bagian penting dari perlindungan konsumen dalam transaksi elektronik. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai perlindungan data pribadi konsumen dalam transaksi elektronik serta bentuk perlindungan hukum yang diberikan berdasarkan hukum positif Indonesia. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Bahan hukum terdiri atas bahan hukum primer, sekunder, dan tersier yang dianalisis secara kualitatif dengan metode preskriptif. Hasil penelitian menunjukkan bahwa perlindungan data pribadi konsumen diatur melalui Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi, Undang-Undang Nomor 1 Tahun 2024 tentang Perubahan Kedua atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, serta Peraturan Pemerintah Nomor 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik yang membentuk kerangka hukum yang saling melengkapi. Perlindungan hukum terhadap data pribadi konsumen diwujudkan melalui perlindungan hukum preventif dan represif untuk menjamin keamanan data pribadi, kepastian hukum, dan pemenuhan hak-hak konsumen dalam transaksi elektronik.

Abstract
The development of electronic transactions has increased the ease with which people acquire goods and/or services, but has also increased the risk of misuse and leakage of consumers personal data. These conditions make legal protection of personal data an important part of consumer protection in electronic transactions. This study aims to analyze the legal arrangements regarding the protection of consumer personal data in electronic transactions as well as the form of legal protection provided under Indonesian positive law. This study is a normative legal research with a statutory approach (statute approach) and conceptual approach (conceptual approach). Legal materials consist of primary, secondary, and tertiary legal materials that are analyzed qualitatively by prescriptive methods. The results showed that consumer personal data protection is regulated through Law Number 8 of 1999 on Consumer Protection, Law Number 27 of 2022 on Personal Data Protection, Law Number 1 of 2024 on the Second Amendment to Law Number 11 of 2008 on Electronic Information and transactions, and Government Regulation Number 71 of 2019 on the implementation of electronic systems and transactions that form a complementary legal framework. Legal protection of consumer personal data is realized through preventive and repressive legal protection to ensure the security of personal data, legal certainty, and fulfillment of consumer rights in electronic transactions.
