Kajian ini menganalisis transformasi arsitektur perlindungan hukum pekerja alih daya (outsourcing) di Indonesia pasca pemberlakuan Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja (UU No. 6/2023), dengan mengambil PT. Karya Insani Sejahtra (PT. KIS) — sebuah Perusahaan Penyedia Jasa Pekerja/Buruh (PPJP) di Makassar — sebagai lokus penelitian. Melalui mekanisme omnibus law, UU No. 6/2023 menghapus pembatasan imperatif jenis pekerjaan yang dapat dialihdayakan sebagaimana diatur Pasal 65 Undang-Undang Nomor 13 Tahun 2003, dan mendelegasikannya kepada Peraturan Pemerintah yang hingga kini belum diterbitkan secara limitatif. Metode penelitian yang digunakan adalah hukum normatif dengan pendekatan perundang-undangan, konseptual, historis, dan komparatif, dianalisis dengan pisau analisis Teori Perlindungan Hukum Philipus M. Hadjon, Teori Keadilan Distributif John Rawls, tiga nilai tujuan hukum Gustav Radbruch, Teori Efektivitas Hukum Soerjono Soekanto, dan Teori Hubungan Industrial Imam Soepomo. Hasil penelitian menunjukkan bahwa perlindungan hukum pekerja outsourcing mengalami defisit pada tiga dimensi Radbruch secara bersamaan: kepastian hukum melemah akibat kekosongan regulasi pelaksana, keadilan terdegradasi karena pergeseran regulasi lebih menguntungkan pengusaha, dan kemanfaatan bersifat kondisional. Penguatan prinsip Transfer of Protection of Employment (TUPE) merupakan satu-satunya capaian normatif yang menguntungkan pekerja, namun implementasinya masih terhambat. Mekanisme penyelesaian sengketa — baik non-litigasi maupun Pengadilan Hubungan Industrial — belum efektif memberikan perlindungan represif akibat fragmentasi kelembagaan dan keterbatasan pengawasan ketenagakerjaan. Penelitian ini merekomendasikan penerbitan Peraturan Pemerintah berbasis positive list, penguatan kapasitas pengawasan ketenagakerjaan, dan reformasi prosedural Undang-Undang Nomor 2 Tahun 2004.

ABSTRACT

This study examines the transformation of the legal protection framework for outsourcing workers in Indonesia following the enactment of Law Number 6 of 2023 on Job Creation (Law No. 6/2023), using PT. Karya Insani Sejahtra (PT. KIS), a Labor Outsourcing Service Provider in Makassar, as the research locus. Through the omnibus law mechanism, Law No. 6/2023 removed the imperative restriction on outsourceable job types previously stipulated in Article 65 of Law Number 13 of 2003, delegating it to a Government Regulation that has yet to be comprehensively issued. This normative legal research employs statute, conceptual, historical, and comparative approaches, analyzed through Philipus M. Hadjon’s Legal Protection Theory, John Rawls’ Theory of Distributive Justice, Gustav Radbruch’s three legal values, Soerjono Soekanto’s Theory of Legal Effectiveness, and Imam Soepomo’s Industrial Relations Theory. The findings indicate a simultaneous deficit across all three Radbruch dimensions: legal certainty is weakened by the absence of implementing regulations, justice is degraded as the regulatory shift disproportionately benefits employers, and utility remains conditional. The strengthened Transfer of Protection of Employment (TUPE) principle is the sole normative gain for workers, though its implementation remains constrained. Existing dispute resolution mechanisms — both non-litigation and the Industrial Relations Court — have not provided effective repressive protection due to institutional fragmentation and limited labor inspection capacity. This study recommends the issuance of a positive-list-based Government Regulation, capacity building for labor inspectorates, and procedural reform of Law Number 2 of 2004.
