ANALISIS YURIDIS PENGAMANAN DEMONSTRASI OLEH SATUAN BRIMOB DALAM DALAM PERSPEKTIF PERLINDUNGAN HAK ASASI MANUSIA (HAM)

Abstrak
Demonstrasi merupakan salah satu instrumen penting dalam kehidupan negara demokratis. Melalui demonstrasi, masyarakat dapat menyampaikan aspirasi, kritik, tuntutan, dan pengawasan terhadap kebijakan pemerintah. Demonstrasi juga menjadi sarana partisipasi publik dalam memperjuangkan kepentingan masyarakat serta menuntut pertanggungjawaban negara. Oleh sebab itu, demonstrasi tidak dapat dipandang semata-mata sebagai gangguan terhadap stabilitas atau ketertiban umum, melainkan sebagai bentuk ekspresi politik dan hukum warga negara yang dijamin oleh konstitusi. Penelitian ini bertujuan untuk mengetahui dan menganalisis pengaturan dalam melaksanakan pengamanan demonstrasi oleh Satuan Brimob dalam sistem hukum Indonesia serta prinsip perlindungan hak asasi manusia dalam pengamanan demonstrasi menurut peraturan perundang-undangan di Indonesia. Penelitian ini merupakan tipe penelitian hukum Normatif yaitu, penelitian yang objek penelitiannya adalah dokumen peraturan perundang-undangan dan bahan pustaka. Penelitian hukum normatif adalah penelitian yang dilakukan dengan pendekatan pada norma atau substansi hukum, asas hukum, teori hukum, dalil-dalil hukum dan perbandingan hukum. Hasil penelitian menunjukkan bahwa Pengaturan pelaksanaan pengamanan demonstrasi oleh Satuan Brimob dalam sistem hukum Indonesia telah tersedia secara berjenjang, mulai dari UUD NRI Tahun 1945, UU Kepolisian, UU Nomor 9 Tahun 1998, hingga peraturan teknis seperti Perkap Nomor 16 Tahun 2006 dan Perkap Nomor 8 Tahun 2009. Namun, pengaturan tersebut masih memiliki kelemahan struktural, yaitu kekosongan norma setingkat undang-undang yang secara khusus mengatur standar penggunaan kekuatan oleh satuan bersenjata dalam konteks sipil, kekaburan parameter eskalasi situasi, serta keterbatasan aksesibilitas peraturan teknis bagi publik, sehingga membuka ruang diskresi berlebih dan potensi penyalahgunaan wewenang. Prinsip perlindungan hak asasi manusia dalam pengamanan demonstrasi telah dirumuskan secara konseptual melalui lima prinsip utama, yaitu legalitas, nesesitas, proporsionalitas, akuntabilitas, dan penghormatan terhadap martabat manusia, yang tersebar dalam pengaturan konstitusional, undang-undang, dan peraturan teknis kepolisian.

Abstract
Demonstrations are an important instrument in the life of a democratic state. Through demonstrations, the public can convey aspirations, criticism, demands, and oversight of government policies. Demonstrations also serve as a means of public participation in advocating for community interests and demanding state accountability. Therefore, demonstrations cannot be viewed merely as disruptions to stability or public order, but rather as a form of citizens' political and legal expression guaranteed by the constitution. This study aims to identify and analyze the regulations governing the security management of demonstrations by the Mobile Brigade Corps (Brimob) within the Indonesian legal system, as well as the principles of human rights protection in demonstration security under Indonesian laws and regulations. This research is a normative legal research type, meaning research whose object consists of statutory regulation documents and library materials. Normative legal research is research conducted using an approach based on legal norms or substance, legal principles, legal theories, legal propositions, and comparative law. The research results show that the regulations governing the security management of demonstrations by Brimob within the Indonesian legal system already exist in a hierarchical structure, ranging from the 1945 Constitution of the Republic of Indonesia, the Police Law, Law Number 9 of 1998, down to technical regulations such as Police Chief Regulation (Perkap) Number 16 of 2006 and Perkap Number 8 of 2009. However, these regulations still have structural weaknesses, namely a legislative gap at the statutory level that specifically regulates standards for the use of force by armed units in a civilian context, ambiguity in the parameters for situational escalation, and limited public accessibility to technical regulations—all of which open room for excessive discretion and potential abuse of authority. The principles of human rights protection in demonstration security have been conceptually formulated through five main principles: legality, necessity, proportionality, accountability, and respect for human dignity, which are distributed across constitutional provisions, statutory laws, and technical police regulations.
