Abstract
This research analyzes the legal status of animation generated by artificial intelligence (AI) in Indonesia, based on the principles of fixation and originality as regulated in Law Number 28 of 2014 concerning Copyright, using the animation New Keluarga Somat as a case study in this research. This study is conducted using normative legal research, incprporating statutory, conceptual, and comparative approaches, the study examines relevant regulations, legal doctrines, and principles in Islam. The results of the research show that the fixation requirement is generally met for AI-based works, because AI output manifests in a tangible form. However, the originality requirement remains dependent on human creative contribution, such as prompt creation and making corrections, for the work to be included in the category of works protected by law, and it requires that the work possess a distinctive and personal character, as well as modification. This research also incorporates the perspective of Islamic law haq al-ibtikar and maqasid al-shariah to deepen the analysis. Therefore, this research emphasizes the importance of clearer regulation to ensure legal certainty regarding AI-generated works, while also creating a balancing technological progress with the protection of intellectual works. Consequently, under Indonesian law, AI cannot yet be recognized as a creator. Copyright protection is only granted when human involvement is dominant and the work fulfills the originality requirement.
