Abstract

Islamic commerce emphasizes honesty and fairness in every transaction. Bai' Najasy, considered forbidden under Islamic law, is the practice of placing requests to increase the price of a product without a real intention to purchase. A hadith from Sahih al-Bukhari emphasizes this prohibition due to its elements of deception and market manipulation. With technological advances, price manipulation is now common in digital marketplaces, taking the form of false requests, obfuscating information, and unfair pricing strategies that harm consumers. DSN-MUI Fatwa No. 146 of 2021 clearly prohibits this manipulation practice in online trading to ensure compliance with Sharia principles. This study aims to examine bai' najasy from a classical fiqh perspective and its relationship to the phenomenon of price manipulation in digital marketplaces. Using a literature review method, this study connects classical fiqh concepts with modern regulations to establish a legal and ethical basis for Islamic commerce in addressing contemporary trade challenges. The research findings indicate that price manipulation practices in digital marketplaces can be categorized as bai' najasy, which is forbidden and must be avoided to create a fair and Sharia-compliant trading system.
