Abstrak
Penelitian ini menganalisis penerapan sanksi persaingan usaha oleh Komisi Pengawas Persaingan Usaha (KPPU) dalam perkara pelanggaran kemitraan sebagaimana termuat dalam Putusan Pengadilan Niaga Jakpus No. 08/Pdt.Sus-KPPU/2023 terhadap Putusan KPPU No. 02/KPPU-K/2020. Fokus penelitian mencakup relevansi dan batas kewenangan KPPU dalam menjatuhkan sanksi pelanggaran persaingan usaha pada perkara kemitraan berdasarkan UU UMKM dan UU Persaingan Usaha, serta kesesuaian amar putusan dengan ketentuan kedua undang-undang tersebut. Metode yang digunakan adalah yuridis normatif dengan pendekatan deskriptif analitis, menggunakan bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa KPPU memiliki legitimasi yuridis untuk menindak pelanggaran kemitraan melalui denda atau pencabutan izin usaha sesuai UU UMKM, namun pengaitan langsung dengan aturan persaingan usaha tanpa pembuktian terpisah berpotensi menimbulkan tumpang tindih kewenangan dan pelanggaran asas legalitas. Putusan Pengadilan Niaga menegaskan denda Rp2,5 miliar sah sebagai sanksi kemitraan, sementara perintah penyerahan lahan dan addendum kontrak dinilai ultra vires karena bersifat keperdataan. Penelitian ini merekomendasikan pembatasan tegas dan mekanisme koordinasi antar-lembaga untuk menghindari overlapping jurisdiction serta memperkuat kepastian hukum dalam penegakan kemitraan dan persaingan usaha.

Abstract
This study analyzes the application of competition law sanctions by the Indonesian Competition Commission (KPPU) in partnership violation cases, as reflected in the Central Jakarta Commercial Court Decision No. 08/Pdt.Sus-KPPU/2023 concerning KPPU Decision No. 02/KPPU-K/2020. The research focuses on the relevance and limits of KPPU’s authority to impose competition law sanctions in partnership cases under Law No. 20 of 2008 and Law No. 5 of 1999, as well as the conformity of the ruling with the provisions of these laws. The study employs a normative juridical method with a descriptive-analytical approach, using primary, secondary, and tertiary legal materials. The findings indicate that KPPU has legal legitimacy to sanction partnership violations through fines or business license revocation under Law No. 20 of 2008. However, directly linking such violations to the competition law regime without separate proof risks overlapping jurisdiction and violating the legality principle. The Commercial Court affirmed that the IDR 2.5 billion fine was valid as a partnership sanction, while the orders for land transfer and contract addendum were deemed ultra vires due to their civil nature. This study recommends clear limitations and inter-agency coordination mechanisms to prevent overlapping jurisdiction and to strengthen legal certainty in the enforcement of partnership and competition laws.
