PERAN RUMAH SAKIT DALAM PERJANJIAN TERAPEUTIK ANTARA DOKTER DAN PASIEN

Abstrak
Hak masyarakat atas pelayanan kesehatan dijamin oleh konstitusi dan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, yang menetapkan tanggung jawab rumah sakit, tenaga medis, dan hak pasien. Perjanjian terapeutik menjadi instrumen penting dalam konteks ini, karena menegaskan kesepakatan dan hak serta kewajiban antara tenaga medis dan pasien terkait tindakan medis, sekaligus membangun komunikasi, kepercayaan, dan perlindungan hukum. Rumah sakit berperan strategis tidak hanya sebagai penyedia fasilitas, tetapi juga sebagai institusi yang menjamin mutu layanan, keselamatan pasien, dan pengawasan tenaga medis. Penelitian ini menggunakan metode hukum normatif dengan pendekatan kualitatif melalui studi kepustakaan (library research) untuk menganalisis posisi hukum rumah sakit dalam perjanjian terapeutik. Hasil kajian menunjukkan bahwa rumah sakit, meskipun tidak disebut secara langsung dalam perjanjian terapeutik, tetap merupakan pihak yang integral dan memikul tanggung jawab hukum atas pelaksanaan pelayanan medis. Dasar hukum keterlibatan tersebut tercermin dalam Pasal 1367 KUHPerdata tentang vicarious liability, Pasal 1233 KUHPerdata tentang perikatan, serta Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, yang menegaskan kewajiban rumah sakit untuk menjamin penyelenggaraan pelayanan yang aman dan bermutu. Sehingga Peneliti menyimpulkan bahwa tenaga medis bertindak dalam lingkup kewenangan rumah sakit, sehingga tanggung jawab atas mutu layanan, keselamatan pasien, dan pengawasan tindakan medis melekat pada institusi rumah sakit.

Abstract
The public’s right to health services is guaranteed by the Constitution and Law Number 17 of 2023 on Health, which establishes the responsibilities of hospitals and medical personnel as well as patients’ rights. The therapeutic agreement serves as an important instrument in this context, as it affirms the mutual consent, rights, and obligations between medical personnel and patients regarding medical treatment, while also fostering communication, trust, and legal protection. Hospitals play a strategic role not only as facility providers but also as institutions responsible for ensuring service quality, patient safety, and the supervision of medical personnel. This study employs a normative legal method with a qualitative approach through library research to analyze the legal position of hospitals within therapeutic agreements. The findings indicate that hospitals, although not explicitly mentioned in therapeutic agreements, remain integral parties that bear legal responsibility for the provision of medical services. The legal basis for this involvement is reflected in Article 1367 of the Indonesian Civil Code on vicarious liability, Article 1233 of the Indonesian Civil Code on obligations, and Law Number 17 of 2023 on Health, which emphasizes the hospital’s duty to ensure the delivery of safe and high-quality health services. Therefore, the researcher concludes that medical personnel act within the scope of the hospital’s authority, making the institution legally responsible for the quality of services, patient safety, and supervision of medical actions.
