IMPLEMENTASI KAIDAH AL-KHURUJ MIN KHILAF MUSTAHAB DALAM PRAKTIK IBADAH DAN MUAMALAH MODERN

Kaidah fiqh sebagai upaya untuk memahami asas-asas umum fiqh dan memberikan kemudahan dalam menetapkan hukum bagi masalah-masalah yang dihadapi telah dikembangkan oleh para fuqaha. Salah satu kaidah tersebut adalah kaidah al-khuruju min al-khilaf.  Sebagian orang mengkategorikan kaidah ini sebagai kaidah khusus dalam bidang siyasah. Tetapi, terlihat bahwa praktek penerapan kaidah ini hampir merambah semua bidang fqih di mana terdapat perbedaan pendapat. Maka dari itu penelitian ini berusaha untuk mengetahui bagaimana makna kaidah, sumber hukum dan bagaimana contoh kasus penerapan kaidah al-khuruj min al-khilaf. Sumber datanya berasal dari buku dan jurnal elektronik, keduanya dianggap sebagai sumber primer dan sekunder. Hasil pembahasan adalah 1) Makna al-khuruj min  al-khilaf adalah  mengambil  sikap  kehati-hatian dalam  hukum  syarak,  baik dengan  mengerjakan  persoalan  yang  terjadi  perbedaan  pendapat  ulama  dalam menetapkan  keharusannya  maupun  meninggalkan  perbuatan  yang  terjadi  perbedaan pendapat ulama dalam menetapkan keharamannya. 2) Kaidah ini bersumber dari prinsip kehati-hatian dalam beragama (al-ihtiyat fi ad-dīn) dan praktik para ulama terdahulu yang mengutamakan persatuan umat.  3) Contoh Kasus Penerapan Kaidah Al-Khuruj Min Al-Khilaf yaitu tentang fenomena shalat ied jatuh hari juma’at yaitu apakah wajib solat jumat ketika ia sudah melakukan solat ied, wudhu dan BAB dan BAK.

Abstract

The rules of fiqh as an effort to understand the general principles of fiqh and provide convenience in determining the law for the problems faced have been developed by the fuqaha. One of these rules is the rule of al-khuruju min al-khilaf. Some people categorize this rule as a special rule in the field of siyasah. However, it is seen that the practice of applying this rule has almost penetrated all fields of fiqh where there are differences of opinion. Therefore, this study attempts to find out the meaning of the rule, the source of law and how are examples of cases of applying the rule of al-khuruj min al-khilaf. The data sources come from books and electronic journals, both of which are considered primary and secondary sources. The results of the discussion are 1) The meaning of al-khuruj min al-khilaf is to take a cautious attitude in sharia law, either by working on problems where there is a difference of opinion among scholars in determining its necessity or leaving actions where there is a difference of opinion among scholars in determining its prohibition. 2) This rule is based on the principle of caution in religion (al-ihtiyat fi ad-dīn) and the practices of previous scholars who prioritized the unity of the community. 3) Example of a Case of the Application of the Al-Khuruj Min Al-Khilaf Rule, namely regarding the phenomenon of the Eid prayer falling on Friday, namely whether it is obligatory to pray Friday when he has already performed the Eid prayer, ablution and defecated and urinated
