Perlindungan hukum bagi wartawan perempuan dalam menjalankan tugasnya merujuk pada prinsip kebebasan pers yang termasuk dalam pilar keempat negara demokrasi. Meski telah dilindungi oleh Undang-Undang Nomor 40 Tahun 1999 tentang Pers tidak menutup kasus banyaknya kekerasan berbasis gender yang dihadapi oleh wartawan perempun. Penelitian ini menggunakan yuridis normatif yang mengkaji secara objektif menganai posisi wartawan perempuan dalam konstruksi Undang-Undang Pers dan akredibilitas Undang-Undang Pers sebagai dasar hukum perlindungan bagi wartawan perempuan. Penelitian ini menemukan bahwa Secara komperehensif Undang-Undang Pers tidak cukup menjadi dasar perlindungan hukum bagi wartawan perempuan. Interpretasi perlindungan hukum dalam Pasal 8 Undang-Undang Pers memberikan pandangan luas dan menciptakan ambiguitas yurisdiksi, sehingga muncul ketidakpastian hukum terhadap kasus bias gender. Guna menjaga kebebasan pers diperlukan adanya upaya kolektif dan berbagai pihak secara multi-faceted. Perlu adanya revisi Undang-Undang Pers agar tetap efektif dan relevan memberi perlindungan hukum bagi wartawan perempuan dalam menghadapi beberapa tantangan masa kini.

  Abstract

Legal protection for female journalists in carrying out their duties refers to the principle of freedom of the press, which is included in the fourth pillar of democracy. Although it has been protected by Law Number 40 of 1999 concerning the Press, it does not rule out the many cases of gender- based violence faced by female journalists. This research uses normative jurisprudence that objectively examines the position of women journalists in the construction of the Press Law and the credibility of the Press Law as a legal basis for the protection of women journalists. This study found that the Press Law is not sufficiently comprehensive as a basis for legal protection for women journalists. The interpretation of legal protection in Article 8 of the Press Law provides a broad view and creates jurisdictional ambiguity, resulting in legal uncertainty over gender bias cases. In order to maintain press freedom, a collective and multi-faceted effort is needed. There needs to be a revision of the Press Law so that it remains effective and relevant to provide legal protection for women journalists in facing some of today's challenges.
