Abstrak
Citizen Lawsuit selanjutnya disebut CLS dapat menjadi upaya bagi orang-orang di masa depan sebagi calon warga negara yang mempunyai hak asasi terhadap lingkungan hidup yang jauh dari kata tercemar dan rusak. Melalui perenungan bahwa orientasi dari entitas subjek hukum dalam civil law yang dikenal dengan ungkapan (maxim) nasciturus pro iam nato hebetur, yang dapat diartikan bahwa anak yang belum lahirpun, yang masih dalam kandungan, dianggap telah dilahirkan apabila kepentingan memerlukan.Maka CLS tidak dapat disempitkan maknanya hanya berlaku pada satu masa tapi lebih dari itu ia dapat mewakili kepentingan setiap generasi akan hak terhadap lingkungan hidup sebagai hak asasi manusia. Hal ini juga selaras dengan prinsip-prinsip yang terkandung dalam pembangunan berkelanjutan.Serta bagaimana pertentangan antara Negara dan warga negara terhadap perlindungan terhadap lingkungan hidup jika gugatan-gugatan CLS di formalkan.

Abstract
Citizen Lawsuit, hereinafter referred to as CLS, can be an effort for people in the future as citizens whose human rights to the environment are far from polluted and damaged. Through reflection that the orientation of legal subject entities in civil law is known as the phrase (proverb) nasciturus pro iam nato hebetur, which can be interpreted that even unborn children, who are still in the womb, are related to the interests of interests. So CLS cannot be narrowed down only represents one time but more than that it can represent every generation of the right to the environment as a human right. This is also in line with the principles contained in sustainable development and how the conflict between the State and citizens against protection of the environment if CLS cases were formalized.
