IMPLIKASI HUKUM PASAL 20 UNDANG-UNDANG NOMOR 65 TAHUN 2024 TENTANG PERUBAHAN ATAS UNDANG-UNDANG NOMOR 13 TAHUN 2016 TENTANG PATEN TERHADAP PEMEGANG PATEN DI INDONESIA YANG BERKEADILAN

ABSTRAK
Di era globalisasi, perkembangan teknologi berlangsung begitu pesat, termasuk di Indonesia. Modernisasi dalam ilmu sosial merujuk pada transformasi dari keadaan kurang berkembang menuju kondisi yang lebih baik demi meningkatkan kualitas kehidupan masyarakat. Perkembangan teknologi diarahkan pada peningkatan penguasaan dan pemanfaatan teknologi guna mendukung transformasi perekonomian nasional berbasis keunggulan kompetitif. Untuk menjaga konsistensi dukungan tersebut, sistem inovasi nasional perlu diperkuat melalui lembaga penelitian, pemberdayaan sumber daya manusia, serta pengembangan teknologi di bidang-bidang strategis. Dalam konteks perlindungan kekayaan intelektual, pelaksanaan paten oleh pemerintah masih terbatas pada isu kesehatan, padahal seharusnya mencakup pula aspek pertahanan dan keamanan negara. Penelitian ini mengkaji dua pokok permasalahan: (1) Bagaimana pengaturan Pasal 20 Undang-Undang Nomor 13 Tahun 2016 tentang Paten di Indonesia? (2) Bagaimana perlindungan hukum terhadap pemegang paten atas implikasi Pasal 20 UU Paten terhadap Pasal 27 ayat (1) Perjanjian TRIPS? Penelitian ini menggunakan metode gabungan hukum normatif dan empiris. Pendekatan normatif digunakan untuk menghasilkan argumentasi dan konsep baru dalam menyelesaikan permasalahan, sedangkan pendekatan empiris digunakan untuk mengkaji penerapan Pasal 20 UU Paten secara nyata. Berdasarkan UU Paten, perlindungan paten mencakup paten dan paten sederhana. Paten diberikan untuk invensi yang baru, mengandung langkah inventif, dan dapat diterapkan dalam industri. Sementara paten sederhana diberikan untuk invensi baru berupa pengembangan produk atau proses yang telah ada dan dapat diterapkan dalam industri, dengan fungsi yang lebih praktis dibandingkan invensi sebelumnya.

ABSTRACT
In the era of globalization, technological development is occurring rapidly, including in Indonesia. Modernization in the social sciences refers to the transformation from an underdeveloped state to a better one to improve the quality of people's lives. Technological development is directed at increasing the mastery and utilization of technology to support the transformation of the national economy based on competitive advantage. To maintain consistent support, the national innovation system needs to be strengthened through research institutions, human resource empowerment, and technological development in strategic fields. In the context of intellectual property protection, the implementation of patents by the government is still limited to health issues, even though it should also encompass aspects of national defense and security. This study examines two main issues: (1) How is Article 20 of Law Number 13 of 2016 concerning Patents regulated in Indonesia? (2) How is legal protection for patent holders provided regarding the implications of Article 20 of the Patent Law on Article 27 paragraph (1) of the TRIPS Agreement? This study uses a combination of normative and empirical legal methods. The normative approach is used to generate new arguments and concepts to resolve the problem, while the empirical approach is used to examine the actual application of Article 20 of the Patent Law. According to the Patent Law, patent protection includes patents and simple patents. Patents are granted for inventions that are new, involve an inventive step, and are industrially applicable. Meanwhile, simple patents are granted for new inventions that are improvements to existing products or processes that can be applied industrially, with a more practical function than previous inventions.
