USIA MINIMAL PERKAWINAN TERHADAP PERLINDUNGAN ANAK DI INDONESIA, TURKI, DAN ARAB SAUDI

Abstract
This research examines the comparative legal framework for marriage minimums and child protection in three Muslim-majority countries: Indonesia, Turkey, and Saudi Arabia. Each country has a different legal approach to determining marriage limits, influenced by interpretations of Islamic law, sociocultural conditions, and international pressure on human rights and child protection in Indonesia through the Law. Law Number 16 of 2019 has set a minimum marriage age of 19 years for men and women. Turkey, through the Turkish Civil Code, sets the minimum age at 18 years and 17 years with court approval. Saudi Arabia, through the Personal Status Law 2021, sets the age limit at 18 years for men and women. This study uses a micro-comparative law approach with a qualitative normative method. The results show that all three countries have implemented family law reforms, but the effectiveness of their implementation still faces significant challenges, particularly related to customary practices, socioeconomic disparities, and diverse religious interpretations. Abstrak
Penelitian ini mengkaji perbandingan regulasi usia minimal perkawinan dan perlindungan anak di tiga negara berpenduduk mayoritas Muslim, yaitu Indonesia, Turki, dan Arab Saudi. Masing-masing negara memiliki pendekatan hukum yang berbeda dalam menetapkan batas usia perkawinan, yang dipengaruhi oleh interpretasi hukum Islam, kondisi sosial budaya, serta tekanan internasional terhadap hak asasi manusia dan perlindungan anak. Indonesia melalui Undang- Undang Nomor 16 Tahun 2019 telah menetapkan usia minimal perkawinan 19 tahun bagi laki-laki dan perempuan. Turki melalui Turkish Civil Code menetapkan usia minimal 18 tahun dan 17 tahun dengan persetujuan pengadilan. Arab Saudi melalui Personal Status Law 2021 menetapkan batasan usia 18 tahun bagi laki-lai dan perempuan. Penelitian ini menggunakan pendekatan perbandingan hukum mikro (mikro comparative law approach) dengan metode kualitatif normatif. Hasil penelitian menunjukkan bahwa ketiga negara telah melakukan reformasi hukum keluarga, namun efektivitas implementasinya masih menghadapi tantangan signifikan, terutama terkait praktik adat, kesenjangan sosial ekonomi, dan interpretasi keagamaan yang beragam
