Peranan Hukum Arbitrase terhadap Efektivitas Penyelesaian Sengketa Influencer Marketing di Indonesia

Abstrak
Perkembangan influencer marketing sebagai bagian dari ekonomi digital menimbulkan berbagai bentuk hubungan hukum antara pelaku usaha dan influencer yang berpotensi menimbulkan sengketa. Sengketa tersebut umumnya berkaitan dengan wanprestasi dalam pelaksanaan kontrak endorsement, seperti ketidaksesuaian konten, keterlambatan publikasi, maupun tidak dipenuhinya kewajiban pembayaran. Penelitian ini bertujuan untuk menganalisis peranan hukum arbitrase sebagai instrumen penyelesaian sengketa serta menilai efektivitasnya dalam praktik influencer marketing di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa secara normatif, arbitrase sebagaimana diatur dalam Undang-Undang Nomor 30 Tahun
1999 memiliki keunggulan dalam hal kerahasiaan, efisiensi, dan fleksibilitas. Namun dalam praktiknya, penggunaan arbitrase masih belum optimal karena rendahnya pemahaman para pihak serta minimnya pencantuman klausula arbitrase dalam kontrak. Oleh karena itu, diperlukan peningkatan kesadaran hukum dan optimalisasi penggunaan arbitrase dalam sengketa digital. Abstract
The development of influencer marketing as part of the digital economy has created various forms of legal relationships between business actors and influencers, which potentially lead to disputes. These disputes generally arise from breaches of contract in endorsement agreements, such as content inconsistency, delays in publication, and failure to fulfill payment obligations. This study aims to analyze the role of arbitration law as a dispute resolution instrument and to assess its effectiveness in the practice of influencer marketing in Indonesia. The research method used is normative juridical with statutory and conceptual approaches. The results show that, normatively, arbitration as regulated under Law Number 30 of 1999 offers advantages in terms of confidentiality, efficiency, and flexibility. However, in practice, the use of arbitration remains
suboptimal due to the lack of legal awareness among the parties and the absence of arbitration clauses in contracts. Therefore, it is necessary to enhance legal awareness and optimize the use of arbitration in digital disputes.
