EFEKTIVITAS MEDIASI DI PENGADILAN BERDASARKAN PERATURAN MAHKAMAH AGUNG NOMOR 1 TAHUN 2016

ABSTRAK
Mediasi di pengadilan merupakan instrumen penyelesaian sengketa yang diwajibkan dalam setiap perkara perdata di Indonesia berdasarkan Peraturan Mahkamah Agung Nomor 1 Tahun 2016. Kehadiran mediasi dimaksudkan untuk menciptakan proses penyelesaian sengketa yang lebih cepat, sederhana, dan berbiaya ringan dibandingkan dengan proses litigasi. Penelitian ini bertujuan untuk menganalisis efektivitas pelaksanaan mediasi di pengadilan serta mengidentifikasi faktor-faktor yang mempengaruhinya. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa secara normatif, mediasi telah memiliki dasar hukum yang kuat dan sistematis. Namun secara empiris, tingkat keberhasilan mediasi masih relatif rendah. Hal ini disebabkan oleh rendahnya itikad baik para pihak, keterbatasan mediator profesional, serta kuatnya budaya litigasi di masyarakat. Dengan demikian, efektivitas mediasi masih belum optimal dan memerlukan penguatan baik dari aspek struktural maupun kultural.

ABSTRACT
Court mediation is a mandatory dispute resolution instrument in all civil cases in Indonesia, as stipulated in Supreme Court Regulation No. 1 of 2016. Mediation is intended to create a faster, simpler, and less expensive dispute resolution process compared to litigation. This study aims to analyze the effectiveness of court mediation and identify influencing factors. The research method used is normative juridical, with a statutory and conceptual approach. The results indicate that, normatively, mediation has a strong and systematic legal basis. However, empirically, the success rate of mediation remains relatively low. This is due to the low level of good faith among the parties, the limited number of professional mediators, and the strong culture of litigation in society. Thus, the effectiveness of mediation is still suboptimal and requires strengthening both structurally and culturally.
