KEPATUHAN HUKUM EKONOMI SYARIAH DALAM PRAKTIK BISNIS JASA DESAIN GRAFIS: ANALISIS AKAD ISTISHNA' DAN PRINSIP HALAL PADA STUDI KASUS RICKY ROMEXIO

Abstrak
Industri jasa desain grafis tumbuh pesat di era digital sebagai sektor bisnis kreatif yang menjanjikan, namun praktiknya sering kali belum sejalan dengan prinsip Hukum Ekonomi Syariah (HES). Penelitian ini menganalisis kepatuhan pelaku industri terhadap prinsip syariah serta faktor yang mempengaruhinya, dengan fokus studi pada Ricky Romexio. Menggunakan metode kualitatif melalui pendekatan hukum empiris, data dihimpun melalui teknik observasi, wawancara mendalam, dan dokumentasi. Hasil penelitian menunjukkan empat temuan utama. Pertama, dalam penggunaan perangkat lunak, subjek selalu memanfaatkan aplikasi dan aset berlisensi bebas royalti untuk menghindari pelanggaran hak cipta. Kedua, pemilihan klien dan proyek dilakukan secara selektif dengan mempertimbangkan kehalalan bisnis, kehalalan proyek, serta kesesuaian nilai Islam. Ketiga, kehalalan objek desain dipastikan melalui penyajian gambar dan konten yang sejalan dengan norma agama Islam. Keempat, penerapan akad istishna’ telah sesuai dengan literatur HES, tercermin dari transparansi proses kesepakatan, spesifikasi desain, harga, sistem pembayaran, jangka waktu, hingga mekanisme penyerahan hasil serta revisi produk. Kepatuhan ini disimpulkan mampu mengoptimalkan kualitas layanan dan citra bisnis secara berkelanjutan.

Abstract
The graphic design services industry is growing rapidly in the digital era as a promising creative business sector, yet its practices often misalign with Sharia Economic Law (SEL) principles. This study analyzes industry players' sharia compliance and its influencing factors, focusing on graphic designer Ricky Romexio. Employing a qualitative method with an empirical legal approach, data were gathered through observation, in-depth interviews, and documentation. The findings reveal four primary points. First, regarding software and licensing, the subject consistently utilizes royalty-free applications and assets to prevent copyright infringement. Second, client and project selection is conducted selectively, considering the halal status of the business, project legitimacy, and Islamic values. Third, the halal status of design objects is ensured through images and content that strictly adhere to Islamic norms. Fourth, the implementation of the istishna’ contract aligns with SEL literature, as demonstrated by transparency in the agreement process, design specifications, pricing, payment terms, timelines, delivery, and revision mechanisms. This compliance is concluded to successfully optimize service quality and corporate image sustainably.
