Pasal 42 Undang-Undang Nomor 30 Tahun 2002 tentang KPK yang mengatur kewenangan Komisi Pemberantasan Korupsi (KPK) dalam perkara korupsi koneksitas TNI-sipil selama ini dirumuskan secara terbuka (open norm) sehingga menimbulkan multitafsir dan inkonsistensi penegakan hukum, sebagaimana tercermin dalam kasus Basarnas, AW-101, dan Bakamla. Melalui Putusan Mahkamah Konstitusi Nomor 87/PUU-XXI/2023, MK memberikan pemaknaan baru atas pasal tersebut dengan menegaskan bahwa KPK berwenang mengusut tuntas perkara koneksitas sepanjang ditangani/ditemukan sejak awal oleh KPK. Penelitian ini bertujuan menganalisis konstruksi kewenangan KPK pasca putusan tersebut menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, kasus, dan konseptual, serta pisau analisis teori kepastian hukum Gustav Radbruch dan teori yurisdiksi berganda (concurrent jurisdiction). Hasil penelitian menunjukkan bahwa putusan MK mengubah basis penentuan forum koneksitas dari prinsip titik berat kerugian (centrum gravitatis) menjadi prinsip penemu/penanganan pertama yang lebih operasional namun masih parsial dalam memberikan kepastian hukum. Putusan ini juga belum diikuti harmonisasi dengan KUHAP dan UU Peradilan Militer, serta menghadapi kesenjangan implementasi (implementation gap) di lapangan, sehingga efektivitasnya sangat bergantung pada komitmen koordinasi antarlembaga KPK, TNI, dan Kejaksaan.

Abstract
Article 42 of Law Number 30 of 2002 on the Corruption Eradication Commission (KPK), which governs the KPK's authority over connexity corruption cases involving both civilians and military (TNI) personnel, has long been formulated as an open norm, resulting in divergent interpretations and inconsistent law enforcement, as reflected in the Basarnas, AW-101, and Bakamla cases. Through Constitutional Court Decision Number 87/PUU-XXI/2023, the Court provided a new interpretation of the article, affirming that the KPK has the authority to fully investigate connexity cases as long as they are handled or discovered from the outset by the KPK. This study aims to analyze the construction of the KPK's authority following the decision using a normative legal research method with statute, case, and conceptual approaches, applying Gustav Radbruch's theory of legal certainty and the theory of concurrent jurisdiction as analytical tools. The findings show that the Court's decision shifted the basis for determining the competent forum in connexity cases from the principle of centrum gravitatis (the weight of loss) to a "first handler/discoverer" principle, which is more operational but still provides only partial legal certainty. The decision has also not yet been harmonized with the Criminal Procedure Code (KUHAP) and the Military Justice Law, and faces an implementation gap in practice, meaning its effectiveness ultimately depends on the institutional coordination commitment among the KPK, the TNI, and the Prosecutor's Office.
