Skripsi ini berjudul “Implementasi Undang-Undang Nomor 30. Tahun 2009 Tentang Ketenagalistrikan Perspektif Fiqh Siyasah Tanfidziyah (Studi Kasus di Kecamatan Tilatang Kamang).” Yang ditulis oleh Elsa Meldian, NIM. 1321.004, Program Studi Hukum Tata Negara (Siyasah), Fakultas Syariah, Universitas Islam Negeri (UIN) Sjech M. Djamil Djambek Bukittinggi.. Metode yang digunakan adalah penelitian empiris dengan pendekatan kualitatif. Data diperoleh melalui wawancara dengan informan seperti petugas lapangan PLN, walinagari, dan masyarakat terdampak, serta studi dokumen. Hasil penelitian menunjukkan bahwa pelaksanaan hak kompetensi tanah di wilayah Nagari Koto Tangah telah melalui prosedur komunikasi yang transparan dan tidak merugikan individu secara sepihak. Namun, masyarakat perlu lebih memahami hak-hak hukumnya terkait kepemilikan tanah agar dapat melakukan advokasi atau musyawarah dengan baik bila terjadi pelanggaran prosedur. Dalam perspektif fiqh siyasah tanfidziyah, kebijakan ini dinilai sebagai upaya mewujudkan maslahah ummah dengan mengatur kepentingan umum atas dasar keadilan dan kemaslahatan. Kesimpulan dari penelitian ini adalah implementasi UU Ketenagalistrikan di Kecamatan Tilatang Kamang telah berjalan sesuai prinsip siyasah tanfidziyah yang mengedepankan kemaslahatan publik, namun perlu penguatan pemahaman hukum masyarakat dan pengawasan prosedur lapangan. Penelitian selanjutnya disarankan untuk memperluas cakupan wilayah dan meninjau perspektif hukum perdata atau kebijakan publik terkait efektivitas dana kompensasi.

Abstract

This thesis is entitled "Implementation of Law Number 30 of 2009 concerning Electricity from the Perspective of Fiqh Siyasah Tanfidziyah (Case Study in Tilatang Kamang District)." Written by Elsa Meldian, Student ID Number 1321.004, State Constitutional Law (Siyasah) Study Program, Faculty of Sharia, Sjech M. Djamil Djambek State Islamic University (UIN) Bukittinggi Electricity is a basic need for national development and public welfare. The state, through the Electricity Supply Business License, is mandated to ensure the equitable availability of electricity. To that end, Law Number 30 of 2009 concerning Electricity grants special rights in the form of land competency rights to electricity providers. This study aims to analyze the implementation of Law Number 30 of 2009 concerning Electricity. This study examines the implementation of Law No. 30 of 2009 in Tilatang Kamang District, specifically regarding land competency rights and compensation, and assesses it from the perspective of legal principles (fiqh) of siyasah tanfidziyah (public administration). The method used was empirical research with a qualitative approach. Data were obtained through interviews with informants such as PLN field officers, village heads, and affected communities, as well as document analysis. The results indicate that the implementation of land competency rights in Nagari Koto Tangah has been carried out through transparent communication procedures and does not unilaterally disadvantage individuals. However, the community needs to better understand their legal rights regarding land ownership so they can effectively advocate or deliberate in cases of procedural violations. From the perspective of legal principles (fiqh) of siyasah tanfidziyah, this policy is considered an effort to realize the public interest by regulating the public interest based on justice and public welfare. The conclusion of this study is that the implementation of the Electricity Law in Tilatang Kamang District has been carried out in accordance with the principles of siyasah tanfidziyah, which prioritize public welfare. However, it requires strengthening community legal understanding and monitoring of field procedures. Further research is recommended to expand the scope of the area and review the civil law or public policy perspectives regarding the effectiveness of compensation funds.
