PENYELESAIAN HUKUM ATAS WANPRESTASI KETERLAMBATAN PADA PENGIRIMAN OBJEK TRANSAKSI DI EKSPEDISI SHOPEE EXPRESS MENURUT AKAD DHAMAN DAN UU NOMOR 30 TAHUN 1999

Abstrak
Perkembangan transaksi elektronik meningkatkan ketergantungan masyarakat pada jasa ekspedisi, salah satunya adalah Shopee Express. Namun, keterlambatan pengiriman masih kerap terjadi dan menimbulkan kerugian bagi konsumen sehingga dikategorikan sebagai wanprestasi. Penelitian ini mengangkat permasalahan mengenai bentuk tanggung jawab hukum Shopee Express atas keterlambatan pengiriman, mekanisme pemberian kompensasi kepada konsumen yang dirugikan, serta kesesuaian mekanisme tersebut dengan Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa serta prinsip akad dhaman al-‘aqd dalam hukum Islam. Penelitian ini menggunakan metode kualitatif deskriptif dengan pendekatan normatif-empiris, melalui wawancara dan dokumentasi terhadap pihak Shopee Express dan konsumen yang mengalami keterlambatan. Hasil penelitian menunjukkan bahwa Shopee Express memikul tanggung jawab hukum penuh berdasarkan Pasal 7 dan Pasal 19 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen serta konsep dhaman al-‘aqd, dengan mekanisme kompensasi berjenjang mulai dari Garansi Tepat Waktu, Pusat Bantuan, hingga mediasi, yang secara formal telah sesuai, namun belum menjangkau kerugian immateriil konsumen. Penelitian ini menyarankan agar Shopee Express mengembangkan skema kompensasi yang lebih komprehensif dan transparan, serta agar pembuat kebijakan memperluas penafsiran Pasal 19 UUPK guna mencakup pemulihan kerugian nonfinansial konsumen.

Abstract
The growth of e-commerce transactions has increased public reliance on expedition services such as Shopee Express, yet shipment delays remain common and often cause losses to consumers, categorizing such delays as a breach of contract (wanprestasi). This study addresses the legal responsibility borne by Shopee Express for delivery delays, the compensation mechanism provided to affected consumers, and the conformity of that mechanism with Law Number 30 of 1999 on Arbitration and Alternative Dispute Resolution as well as the principle of dhaman al-‘aqd in Islamic law. A descriptive qualitative method with a normative-empirical approach was employed, using interviews and documentation involving Shopee Express and consumers who experienced delays. The findings show that Shopee Express bears full legal responsibility under Articles 7 and 19 of Law Number 8 of 1999 on Consumer Protection and the concept of dhaman al-‘aqd, through a tiered compensation mechanism from the On-Time Guarantee program and Help Center handling to cooperative mediation that is formally adequate yet still excludes consumers' immaterial losses. The study recommends that Shopee Express develop a more comprehensive and transparent compensation scheme, and that policymakers broaden the interpretation of Article 19 of the Consumer Protection Law to include recovery of consumers' non-financial losses.
