Pelaksanaan pemilu serentak di Indonesia telah menimbulkan berbagai persoalan, antara lain meningkatnya beban kerja penyelenggara pemilu, menurunnya kualitas partisipasi pemilih, serta belum optimalnya perwujudan prinsip demokrasi yang substantif. Fenomena tersebut melatarbelakangi lahirnya Putusan Mahkamah Konstitusi Nomor 135/PUU-XXII/2024 yang menetapkan pemisahan antara Pemilu Nasional dan Pemilu Daerah mulai tahun 2029. Permasalahan hukum dalam penelitian ini meliputi dasar pertimbangan hukum Mahkamah Konstitusi dalam memisahkan penyelenggaraan pemilu serta implikasi yuridis putusan tersebut terhadap pengaturan masa transisi Dewan Perwakilan Rakyat Daerah (DPRD). Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan putusan, yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pemisahan jadwal pemilu berpotensi menimbulkan kekosongan jabatan maupun perpanjangan masa jabatan DPRD apabila tidak disertai pengaturan masa transisi yang jelas. Penelitian ini menyimpulkan bahwa diperlukan pengaturan masa transisi DPRD melalui perubahan Undang-Undang Pemilu dan Undang-Undang Pilkada guna menjamin kepastian hukum, menjaga keberlangsungan pemerintahan daerah, serta tetap menjunjung prinsip kedaulatan rakyat.

Abstract

The implementation of simultaneous elections in Indonesia has generated various structural problems, including excessive workloads for election organizers, declining voter participation quality, and the inadequate realization of substantive democratic principles. This phenomenon led to the issuance of Constitutional Court Decision Number 135/PUU-XXII/2024, which mandates the separation of National Elections and Regional Elections starting in 2029. The legal issues examined in this study concern the constitutional reasoning of the Constitutional Court in separating the election schedules and the legal implications of the decision for regulating the transitional term of office the Regional People’s Representative Council (DPRD). This research employs a normative legal research method using statutory and case approaches, analyzed qualitatively. This result indicates that the separation of election schedules has the potential to create a vacancy or an extension of the DPRD’s term of office if transitional arrangements are not clearly regulated. The study concludes that a clear and comprehensive legal framework governing the transitional period is necessary through amendments to the Election Law and the Regional Election Law in order to ensure legal certainty, maintain the continuity of regional governance, and uphold the principle of popular sovereignty.
