ANALISIS YURIDIS PENGANGKATAN JABATAN APARATUR SIPIL NEGARA PASCA DEMOSI

Abstrak
Pengangkatan jabatan ASN pasca demosi secara normatif wajib memenuhi masa hukuman disiplin dan masa tunggu sebagaimana diatur dalam Peraturan Pemerintah Nomor 94 Tahun 2021 dan Peraturan BKN Nomor 6 Tahun 2022, namun praktiknya ‘‘N’’ diangkat sebagai Direktur Bina Perluasan Kesempatan Kerja Kementerian Ketenagakerjaan sebelum seluruh ketentuan terpenuhi sehingga menimbulkan permasalahan mengenai kesesuaian pengangkatan dan implikasi hukumnya. Pokok permasalahan ini adalah pengangkatan ‘‘N’’ sebagai Direktur Bina Perluasan Kesempatan Kerja Kementerian Ketenagakerjaan dan implikasi hukum pengangkatan ‘‘N’’ sebagai Direktur Bina Perluasan Kesempatan Kerja Kementerian Ketenagakerjaan menurut peraturan perundang-undangan. Metode penelitian ini tipe normatif dengan sifat deskriptif. Data yang digunakan yaitu data sekunder. Hasil penelitian menunjukkan bahwa pengangkatan ‘‘N’’ sebagai Direktur Bina Perluasan Kesempatan Kerja Kementerian Ketenagakerjaan tidak sesuai dengan Pasal 8 ayat (4) huruf a Peraturan Pemerintah Nomor 94 Tahun 2021 dan Pasal 54 ayat (2) Peraturan BKN Nomor 6 Tahun 2022 karena dilakukan ketika ‘‘N’’ masih menjalani hukuman disiplin berat dan belum memenuhi masa tunggu untuk dapat diangkat kembali dalam jabatan. Pengangkatan tersebut berimplikasi hukum cacat substansi pada keputusan administrasi sehingga dapat dicabut atau dibatalkan berdasarkan Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan, menimbulkan ketidakpastian hukum terhadap status jabatan yang diperoleh, dan dapat menjadi objek sengketa tata usaha negara.

Abstract
Normatively, the appointment of a State Civil Apparatus (ASN) member following a demotion requires the completion of the disciplinary penalty period and the mandatory waiting period, as stipulated in Government Regulation Number 94 of 2021 and BKN Regulation Number 6 of 2022. However, in practice, "N" was appointed as the Director of Employment Opportunity Expansion Development at the Ministry of Manpower before all requirements were met, thereby raising issues regarding the propriety of the appointment and its legal implications. The core issues addressed are the appointment of "N" to this position and the legal implications of said appointment under prevailing laws and regulations. This study employs a normative research method with a descriptive nature, utilizing secondary data. The findings indicate that the appointment of "N" was inconsistent with Article 8 paragraph (4) letter a of Government Regulation Number 94 of 2021 and Article 54 paragraph (2) of BKN Regulation Number 6 of 2022, as it occurred while "N" was still serving a severe disciplinary penalty and had not yet fulfilled the waiting period required for reappointment to a position. This appointment resulted in a substantive defect in the administrative decision—rendering it liable for revocation or annulment under Law Number 30 of 2014 concerning Government Administration—created legal uncertainty regarding the obtained position, and could become the subject of an administrative law dispute.
