Abstrak
Penelitian ini bertujuan mengkonstruksi hukum terhadap modus muslihat yang lahir dari kondisi tidak setara dan tekanan psikis mengacu pada konsep grooming yang menegaskan bahwa hukum harus melihat konteks sosial. Hasil penelitian ini menemukan konstruksi hukum sebagaimana isi putusan, telah menggeser paradigma pembuktian dari korban kepada pertanggungjawaban pelaku atas penyalahgunaan kuasanya dan dampaknya kepada korban bukan hanya berfokus pada unsur fisik.
Abstract
This study aims to construct the law regarding the deceitful ruse modus that arises from unequal conditions and psychological pressure, referring, to the concept of grooming, which affirms that the law must consider the social context. The result s of this study found that the legal construction as contained in the decision has shifted the paradigm of proof and the victim toward the perpetrator’s accountability for the abuse of power and its impact on the victim, rather than focusing solely on physical elements
