Abstract

Abstract

One of the sources of pollution with the highest level of risk is hazardous and toxic waste (B3 waste). B3 waste is the residue of a business and/or activity that contains hazardous and toxic substances. Pollution by B3 waste may occur through either negligence (culpa) or intent (dolus) on the part of individuals or business entities. For this reason, Article 59 paragraph (1) of the Environmental Protection and Management Law (UU PPLH) requires every person who generates B3 waste to manage the B3 waste they generate. This provision is further elaborated in Government Regulation Number 22 of 2021 on the Implementation of Environmental Protection and Management (PP 22/2021), which also revoked Government Regulation Number 101 of 2014 on the Management of Hazardous and Toxic Waste. PP 22/2021, among others through Article 276, sets out the stages of B3 waste management that every B3 waste generator must fulfill. This study aims to examine the enforcement of hazardous and toxic (B3) waste management law in Makassar City and the factors affecting the effectiveness of that enforcement. This is an empirical legal study (juridical-empirical or socio-legal research), which does not stop at examining written legal norms (law in the books) but investigates how the law actually operates in society (law in action). The research was conducted in Makassar City, with its main locus in Bontoala District, particularly along Jalan Veteran, which runs through the district. The study finds that the enforcement of B3 waste management law in Makassar City has not been effective, particularly with respect to automotive repair shops in Bontoala District. The regulatory framework is complete, comprising UU PPLH, PP No. 22 of 2021, and Makassar City Regional Regulation Number 9 of 2016, yet in practice business compliance remains low. As many as 90% of repair shops do not reduce their waste and 70% do not sort it. Supervision has not yet reached small businesses, and no administrative or criminal sanctions have been imposed. As a result, the legal norms have no deterrent effect and have not changed the behavior of business actors. The effectiveness of law enforcement is influenced by five interrelated factors. First, the legal factor: the Regional Regulation has not been aligned with the Job Creation Law and PP 22/2021, and there are no technical regulations for small businesses. Second, the law enforcement factor: the number of officers is limited, officers prioritize guidance over enforcement action, and inter-agency coordination is weak. Third, the facilities factor: facilities for supervision and for B3 waste storage are limited. Fourth, the community factor: business actors do not comply even though they have sufficient knowledge. Fifth, the legal culture factor: there is a habit of selling used oil to unlicensed collectors and a permissive attitude toward violations. The most dominant factor is the law enforcement factor.
