ANALISIS KEBIJAKAN HUKUM TATA RUANG, ALIH FUNGSI KAWASAN MANGROVE MENJADI JALAN LINGKAR DI KOTA PALOPO

Abstrak
Pembangunan jalan lingkar di Palopo yang melewati kawasan mangrove menimbulkan pertanyaan tentang kesesuaian tata ruang dan legalitas alih fungsi lahan.Menurut Undang-Undang Nomor 26 Tahun 2007 tentang Penataan Ruang menyatakan kawasan mangrove termasuk kawasan lindung yang harus dilestarikan. Penelitian ini bertujuan untuk memahami regulasi yang mengatur kawasan lindung dan batasan alih fungsi lahan, khususnya hutan mangrove yang ada di Jalan Lingkar kota Palopo. Adapun metode penelitian ini ialah metode yuridis empiris dengan pendekatan deskriptif kualitatif, data diperoleh melalui wawancara mendalam, observasi, studi dokumentasi dan kajian pustaka. Hasil penelitian ini menunjukkan bahwa dengan adanya pembangunan Jalan Lingkar tersebut memberikan banyak dampak positif kepada masyarakat, khususnya para UMKM yang mendirikan usahanya. Selain itu, dengan adanya Jalan Lingkar ini, juga memberikan sebagian dampak negatif karena mengalih fungsikan kawan mangrove menjadi jalan lingkar ini akan membuat terganggunya fungsi ekologis hutan mangrove terhadap lingkungan fisik biologis.

Abstract
The construction of a ring road in Palopo, which passes through a mangrove area, raises questions about the suitability of spatial planning and the legality of land conversion. Law No. 26 of 2007 concerning Spatial Planning states that mangrove areas are protected areas that must be preserved. This study aims to understand the regulations governing protected areas and the boundaries of land conversion, specifically the mangrove forest along the Palopo Ring Road. The research method is empirical-legal with a qualitative descriptive approach. Data were obtained through in-depth interviews, observations, documentation studies, and literature reviews. The results indicate that the construction of the Ring Road has had many positive impacts on the community, particularly the MSMEs establishing their businesses. Furthermore, the construction of the Ring Road also has some negative impacts, as converting mangrove areas into a ring road will disrupt the ecological function of the mangrove forest and its impact on the physical and biological environment.
