PENGEMBANGAN MODEL PERLINDUNGAN HUTAN BERBASIS KOMUNITAS ADAT DALAM MENINGKATKAN PARTISIPASI MASYARAKAT

Abstrak
Penelitian ini bertujuan untuk mengetahui dan menganalisis Bagaimana model perlindungan hutan berbasis komunitas adat dapat di kembangkan untuk meningkatkan partisipasi Masyarakat dalam pelestarian linkungan dan apa saja faktor yang mempengaruhui efektifitas penerapan model perlindungan hutan berbasis komonitas adat dalam meningkatkan partispasi Masyarakat.metode penelitian yang di gunakan adalah normatif empiris dengan menganalisis norma-norma yang ada, tetapi juga menguji bagaimana norma-norma tersebut diterapkan dalam praktik melalui pengumpulan data empiris yang berkaitan dengan artikel ini. Hasil penelitian menunjukan bahwa perlindungan hutan berbasis komunitas adat sangat penting dan efektif dalam menjaga kelestarian hutan. Masyarakat adat memiliki peran aktif dalam pengelolaan hutan dan memiliki kearifan lokal yang dapat diintegrasikan dengan hukum formal. Penerapan sanksi adat sebagai sanksi awal sebelum diterapkannya sanksi pidana juga diatur dalam hukum formal. Selain itu, pengelolaan hutan juga memiliki dampak positif terhadap kesejahteraan masyarakat adat .perturan mengenai Perlindugan hutan adat menggunakan peraturan UUD 1945, putusan MK 35/2012.

Abstract
This study aims to determine and analyze how a community-based forest protection model can be developed to increase community participation in environmental conservation and the factors that influence the effectiveness of implementing a community-based forest protection model in increasing community participation. The research method used is a normative-empirical approach, analyzing existing norms and also examining how these norms are applied in practice through the collection of empirical data related to this article. The results show that community-based forest protection is crucial and effective in maintaining forest sustainability. Indigenous communities play an active role in forest management and possess local wisdom that can be integrated with formal law. The application of customary sanctions as a preliminary sanction before criminal sanctions are also regulated in formal law. Furthermore, forest management also has a positive impact on the welfare of indigenous communities. Regulations regarding customary forest protection use the 1945 Constitution and Constitutional Court Decision No. 35/2012.
