PERAN MODIN DALAM PROSES PENCATATAN PERKAWINAN DI KUA KECAMATAN PRAGAAN KABUPATEN SUMENEP

Abstrak
Peran modin masih sangat dibutuhkan di kalangan masyarakat Pragaan dalam mengurusi administrasi perkawinan, meskipun secara formal fungsinya sebagai Pembantu Pegawai Pencatat Nikah (P3N) telah dihapus berdasarkan Instruksi Dirjen Bimas Islam No. DJ.II/1 Tahun 2015. Meskipun demikian, dalam praktiknya masyarakat Pragaan tetap memanfaatkan jasa modin dalam mengurus pencatatan perkawinan. Kepercayaan masyarakat terhadap modin tidak lepas dari kedekatan kultural dan spiritual yang telah terjadi secara turun-menurun. Fokus penelitian ini adalah: (1) Bagaimana proses pencatatan perkawinan di KUA Kecamatan Pragaan Kabupaten Sumenep; dan (2) Bagaimana peran modin dalam mengurusi administrasi perkawinan di KUA Kecamatan Pragaan Kabupaten Sumenep dalam perspektif hukum Islam. Penelitian ini merupakan penelitian Hukum Empiris dengan pendekatan penelitian kualitatif. Data yang diperoleh dari penelitian ini yaitu dengan wawancara, observasi, dan dokumentasi. Adapun sumber data yang diperoleh melalui Masyarakat, Modin, dan pihak KUA. Adapun Teknik analisis datanya menggunakan reduksi data, display data (penyajian data), Penarikan Kesimpulan, dan Metode Penelitian dalam Hukum Islam. Sedangkan teknik pengecekan datanya menggunakan perpanjangan Pengamatan, ketekunan pengamatan, triangulasi. Hasil penelitian menunjukkan bahwa: peran modin dalam membantu melayani pernikahan di masyarakat meliputi sejumlah tugas penting, seperti mempersiapkan dokumen dan berkas penting untuk kebutuhan administrasi pernikahan; menjadi perantara antara masyarakat dengan KUA setempat. Secara yuridis, KUA Kecamatan Pragaan tidak lagi menerapkan Keputusan Dirjen Bimas Islam Nomor 977 Tahun 2018 karena peran modin secara formal telah dihapus. Namun, melihat besarnya kontribusi modin yang sudah melekat secara sosial dan fungsional, maka layak dipertimbangkan untuk ditugaskan kembali sebagai P3N atau P4. Dalam perspektif hukum Islam, tidak terdapat larangan mutlak bagi modin menerima biaya jasa, selama biaya tersebut wajar, dan tidak membebani. Biaya jasa ini harus berlandaskan prinsip keadilan, transparansi, dan keikhlasan, sehingga praktiknya tidak bertentangan dengan nilai-nilai dasar hukum Islam.

Abstract
The role of the modin remains highly essential among the people of Pragaan in managing marriage administration, even though its formal function as an Assistant Marriage Registrar Officer (P3N) has been abolished based on the Instruction of the Director General of Islamic Community Guidance No. DJ. II/1 of 2015. Nevertheless, in practice, the people of Pragaan continue to rely on the modin for marriage registration services. This enduring trust stems from deep-rooted cultural and spiritual ties that have been passed down through generations.This study focuses on: (1) How the marriage registration process is carried out at the Office of Religious Affairs (KUA) in Pragaan Subdistrict, Sumenep Regency; and (2) What role the modin plays in managing marriage administration at the KUA in Pragaan from the perspective of Islamic law. This research is an empirical legal study using a qualitative approach. Data were collected through interviews, observations, and documentation. Sources of data included community members, modin, and KUA officials. The data analysis techniques used included data reduction, data display, conclusion drawing, and methods of Islamic legal research. Data validity was ensured through extended observation, persistent observation, and triangulation.The results of the study show that the modin plays a significant role in assisting the community with various marriage-related tasks, such as preparing necessary documents for marriage administration and serving as a liaison between the community and the local KUA. Juridically, the KUA in Pragaan Subdistrict no longer implements the Instruction of the Director General of Islamic Community Guidance No. 977 of 2018, as the modin is no longer formally recognized. However, considering the substantial social and functional contributions of the modin, it is deemed appropriate to reconsider their appointment as P3N or P4. From the perspective of Islamic law, there is no absolute prohibition against the modin receiving service fees, as long as such fees are reasonable and not burdensome. These fees must be based on the principles of justice, transparency, and sincerity, and therefore do not conflict with the core values of Islamic law.
