JUAL BELI ONLINE DALAM PERSPEKTIF FIKIH MUAMALAH

Abstrak
Perkembangan teknologi digital telah mengubah pola transaksi perdagangan dari sistem konvensional menjadi jual beli berbasis online. Praktik jual beli online menawarkan kemudahan dan efisiensi, namun di sisi lain menimbulkan berbagai permasalahan dari perspektif fikih muamalah, seperti ketidakjelasan objek transaksi, keabsahan akad digital, serta potensi terjadinya penipuan dan ketidakadilan. Penelitian ini bertujuan untuk menganalisis praktik jual beli online dalam perspektif fikih muamalah dengan membandingkan kondisi yang terjadi dan kondisi ideal menurut prinsip syariat Islam. Penelitian ini menggunakan metode kualitatif dengan pendekatan kajian pustaka (library research), melalui analisis terhadap literatur fikih muamalah, Al-Qur’an, Hadis, serta jurnal ilmiah yang relevan. Hasil kajian menunjukkan bahwa jual beli online pada dasarnya diperbolehkan dalam Islam selama memenuhi rukun dan syarat sah akad, serta terbebas dari unsur gharar, riba, dan penipuan. Permasalahan utama bukan terletak pada media digital, melainkan pada substansi pelaksanaan akad. Oleh karena itu, diperlukan penguatan literasi fikih muamalah dan pengaturan transaksi digital yang berlandaskan prinsip keadilan dan transparansi.

Abstract
The development of digital technology has transformed trading transactions from conventional systems to online-based buying and selling. Online transactions offer convenience and efficiency; however, they also raise various issues from the perspective of Islamic jurisprudence (fiqh muamalah), such as ambiguity of transaction objects, validity of digital contracts, and potential fraud. This study aims to analyze online buying and selling practices from the perspective of fiqh muamalah by comparing existing practices with ideal Islamic legal principles. This research employs a qualitative method with a library research approach by examining fiqh muamalah literature, the Qur’an, Hadith, and relevant academic journals. The findings indicate that online buying and selling are permissible in Islam as long as the pillars and conditions of a valid contract are fulfilled and free from gharar, riba, and deception. The main issue lies not in the digital medium but in the substance of contract implementation. Therefore, strengthening fiqh muamalah literacy and establishing transparent and fair digital transaction practices are highly recommended.
