PERTANGGUNGJAWABAN PIDANA TERHADAP TINDAK PIDANA PENCURIAN BESI BLOK PIECE JALAN TOL DALAM KEADAAN MEMBERATKAN YANG DILAKUKAN SECARA BERLANJUT (STUDI PUTUSAN NOMOR 14/PID.B/2025/PN.TJK)

Abstrak
Pencurian adalah kejahatan properti yang paling umum. Penyelidikan ini dilatarbelakangi oleh pencurian potongan besi blok (penyangga penghalang jalan) di jalan tol, yang membahayakan pengguna jalan. Studi Putusan Nomor 14/Pid.B/2025/PN. Tjk mengangkat pertanyaan tentang tanggung jawab pidana bagi pelaku pencurian dan proses pemberian putusan oleh hakim. Studi ini meneliti tanggung jawab pidana dan penalaran hakim. Teknik penelitian adalah hukum normatif dan empiris. Data sekunder dari studi literatur dan data primer dari wawancara dengan penyidik, jaksa, dan hakim digunakan. Temuan induktif diambil dari analisis data hukum kualitatif. Menurut penelitian, terdakwa secara hukum dan meyakinkan bersalah atas pencurian berkelanjutan dalam keadaan yang memberatkan. Terdakwa melanggar Pasal 363 ayat (1) sub-ayat 4 dan Pasal 64 ayat (1) Kitab Undang-Undang Hukum Pidana. Pelaku dijatuhi hukuman 2 tahun penjara setelah hakim tidak menemukan keadaan yang meringankan. Keadaan memberatkan, seperti tindakan terdakwa yang menimbulkan kekhawatiran publik dan merugikan korban, serta faktor-faktor meringankan, seperti perilaku sopan terdakwa dan pengakuan bersalahnya yang merupakan pertimbangan non-hukum (sosiologis) juga diperhitungkan. Keadilan, kejelasan hukum, dan kepentingan umum semuanya dijunjung tinggi oleh putusan pengadilan. Penulis menyarankan untuk meningkatkan patroli jalan tol dan agar hakim mempertimbangkan keselamatan pengguna jalan tol saat menjatuhkan hukuman.

Abstract
Theft is the most common property crime. This investigation was prompted by the theft of concrete blocks (road barriers) on a toll road, which endangered road users. The study of Judgment No. 14/Pid.B/2025/PN. Tjk raises questions regarding the criminal liability of the perpetrators of theft and the process by which judges render their decisions. This study examines criminal liability and judicial reasoning. The research methodology combines normative and empirical legal approaches. Secondary data from literature reviews and primary data from interviews with investigators, prosecutors, and judges were utilized. Inductive findings were derived from the analysis of qualitative legal data. According to the study, the defendant was legally and convincingly found guilty of continuous theft under aggravating circumstances. The defendant violated Article 363(1)(4) and Article 64(1) of the Criminal Code. The defendant was sentenced to 2 years in prison after the judge found no mitigating circumstances. Aggravating circumstances, such as the defendant’s actions that caused public concern and harmed the victim, as well as mitigating factors, such as the defendant’s polite behavior and guilty plea which are non-legal (sociological) considerations were also taken into account. Justice, legal clarity, and the public interest were all upheld by the court’s decision. The author suggests increasing highway patrols and that judges consider the safety of highway users when imposing sentences.
