ASET DIGITAL DALAM BOEDEL PAILIT KOPERASI : KLASIFIKASI DAN PERLINDUNGAN HAK KREDITUR

Abstrak
Penelitian ini bertujuan untuk menganalisis klasifikasi aset digital dalam perspektif hukum benda dan hukum kepailitan serta perlindungan hak kreditur dalam boedel pailit koperasi. Penelitian menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan, doktrin, dan asas hukum yang berkaitan dengan aset digital dalam kepailitan koperasi. Untuk memperkuat analisis normatif, penelitian ini didukung dengan wawancara terhadap pengurus KSP Al-Azhar di Kabupaten Pinrang. Hasil penelitian menunjukkan bahwa KSP Al-Azhar belum memiliki aset digital yang dapat dikategorikan sebagai kekayaan tidak berwujud yang bernilai ekonomi secara mandiri, melainkan masih berupa aset fisik seperti komputer, printer, dan perangkat Wi-Fi. Dalam perspektif hukum benda, aset digital dapat diklasifikasikan sebagai benda tidak berwujud apabila memiliki nilai ekonomi, dapat dikuasai, dan dapat dialihkan. Namun, karena belum terdapat aset digital yang memenuhi unsur tersebut, maka belum terdapat aset digital yang dapat dimasukkan ke dalam boedel pailit koperasi. Penelitian ini juga menemukan bahwa pengelolaan aset koperasi dilakukan melalui mekanisme rapat anggota dan seluruh aset tetap menjadi milik koperasi sebagai badan hukum meskipun terjadi pergantian pengurus. Oleh karena itu, secara normatif aset digital berpotensi menjadi bagian dari boedel pailit apabila di masa mendatang koperasi memiliki aset digital yang bernilai ekonomi dan dapat dibuktikan kepemilikannya. Penelitian ini merekomendasikan perlunya pengaturan yang lebih jelas mengenai kedudukan aset digital dalam hukum kepailitan guna memberikan kepastian hukum dan perlindungan terhadap hak-hak kreditur.

Abstract
This study aims to analyze the classification of digital assets from the perspectives of property law and bankruptcy law, as well as the protection of creditors’ rights in the bankruptcy estate of cooperatives. The research employs a normative juridical method through statutory, doctrinal, and legal principle approaches related to digital assets in cooperative bankruptcy. To strengthen the normative analysis, this study is supported by interviews with the management of KSP Al-Azhar in Pinrang Regency. The results indicate that KSP Al-Azhar does not yet possess digital assets categorized as intangible assets with independent economic value, but rather only physical assets such as computers, printers, and Wi-Fi devices. From the perspective of property law, digital assets may be classified as intangible property if they possess economic value, can be controlled, and can be transferred. However, since no digital assets currently fulfill these criteria, there are no digital assets that can be included in the cooperative bankruptcy estate. The study also finds that cooperative asset management is conducted through member meeting mechanisms, and all assets remain the property of the cooperative as a legal entity despite changes in management. Therefore, normatively, digital assets may potentially become part of the bankruptcy estate in the future if the cooperative owns digital assets with economic value and provable ownership. This study recommends clearer legal regulation regarding the status of digital assets in bankruptcy law to ensure legal certainty and protection of creditors’ rights.
