PT Melania Citra Permata menggunakan data pribadi konsumen dari pendaftaran MCP Membership untuk melayangkan somasi atas kritik di media sosial terkait penyelenggaraan konser. Tindakan ini berpotensi melanggar Pasal 16 ayat (2) huruf b UU Pelindungan Data Pribadi karena pemrosesan data tidak sesuai tujuan awal, serta Pasal 4 huruf d UU Perlindungan Konsumen yang menjamin hak menyampaikan keluhan. Konsumen dapat menempuh upaya non-litigasi melalui mediasi di BPSK, litigasi melalui gugatan Perbuatan Melawan Hukum atau class action, upaya administratif dan pidana.

Abstract

PT Melania Citra Permata used consumers personal data obtained from MCP Membership registration to issue legal notice in response to criticism posted on social media regarding the organization of a concert. This action may violate Article 16 paragraph (2) letter b of the Personal Data Protection Law because the processing of personal data was not carried out in accordance with its original purpose. In addition, it may also conflict with Article 4 letter d of the Consumer Protection Law, which guarantees consumers the right to express complaints and opinions regarding goods and services. Consumers may pursue several legal remedies, including non-litigation mechanisms through mediation before the Consumer Dispute Settlement Agency (BPSK), litigation through a tort claim or class action lawsuit, as well as administrative and criminal remedies.
