ANALISIS HUKUM ISLAM TERHADAP PENGGUNAAN FITUR PAYLATER SEBAGAI METODE PEMBAYARAN PADA TRANSAKSI DIGITAL DI INDONESIA

Abstrak
Perkembangan financial technology (fintech) telah mendorong munculnya layanan Buy Now Pay Later (PayLater) sebagai metode pembayaran yang semakin banyak digunakan dalam transaksi digital di Indonesia. Meskipun memberikan kemudahan, fleksibilitas, dan memperluas inklusi keuangan, mekanisme PayLater juga menimbulkan persoalan hukum Islam, terutama terkait akad, bunga, denda keterlambatan, serta potensi munculnya unsur riba dan gharar. Penelitian ini bertujuan menganalisis penggunaan fitur PayLater sebagai metode pembayaran pada transaksi digital berdasarkan perspektif hukum Islam. Penelitian menggunakan metode kualitatif dengan pendekatan studi kepustakaan (library research) melalui analisis terhadap Al-Qur'an, hadis, fatwa DSN-MUI, peraturan perundang-undangan, serta jurnal nasional dan internasional yang relevan. Hasil penelitian menunjukkan bahwa konsep pembayaran tangguh pada dasarnya diperbolehkan dalam Islam selama memenuhi prinsip fikih muamalah. Namun, mekanisme PayLater konvensional yang masih menerapkan bunga dan denda keterlambatan berpotensi mengandung unsur riba dan belum sepenuhnya sesuai dengan maqāṣid al-syarī‘ah. Oleh karena itu, diperlukan pengembangan layanan PayLater berbasis syariah yang menggunakan akad yang jelas, transparan, bebas dari riba dan gharar, serta didukung oleh penguatan regulasi dan literasi keuangan syariah.

Abstract
The development of financial technology (fintech) has accelerated the adoption of Buy Now Pay Later (PayLater) as a widely used payment method in Indonesia's digital transactions. Despite offering convenience, flexibility, and broader financial inclusion, PayLater also raises Islamic legal concerns, particularly regarding contracts, interest, late payment penalties, and the potential presence of riba and gharar. This study aims to analyze the use of PayLater from the perspective of Islamic law. A qualitative method with a library research approach was employed by examining the Qur'an, Hadith, DSN-MUI fatwas, relevant regulations, and national and international scholarly literature. The findings indicate that deferred payment transactions are fundamentally permissible under Islamic law provided they comply with the principles of fiqh muamalah. However, conventional PayLater schemes that impose interest and late payment penalties potentially involve riba and do not fully align with the objectives of maqāṣid al-sharī'ah. Therefore, the study recommends developing Sharia-compliant PayLater services based on valid Islamic contracts, transparency, and the elimination of riba and gharar, supported by stronger regulations and improved Islamic financial literacy.
