IMPLEMENTASI NILAI KEADILAN DALAM MEDIASI SYARIAH: ANALISIS MAQĀṢID AL-SYARĪ‘AH

Abstrak
Tulisan ini membahas konsep keadilan dalam hukum Islam serta implementasinya dalam proses mediasi syariah dengan pendekatan maqāṣid al-syarī‘ah. Keadilan (al-‘adl) merupakan prinsip fundamental yang menjadi dasar dalam penegakan hukum dan penyelesaian sengketa dalam Islam yang tidak hanya dimaknai secara formal sebagai kesesuaian prosedur, tetapi juga secara substantif sebagai upaya menempatkan hak secara proporsional dan berorientasi pada kemaslahatan. Dalam penyelesaian sengketa, nilai keadilan tercermin dalam keadilan prosedural (al-musāwah), keadilan substantif, dan keadilan dalam perdamaian (al-ṣulḥ). Mediasi syariah sebagai mekanisme penyelesaian sengketa non-litigasi mengedepankan prinsip kesetaraan, keterbukaan, musyawarah, kemanfaatan, amanah, dan perdamaian dengan peran mediator yang strategis dalam menjamin tercapainya keadilan melalui sikap netral, adil, dan berintegritas Dalam perspektif maqāṣid al-syarī‘ah, keadilan dalam mediasi tidak hanya berorientasi pada penyelesaian konflik, tetapi juga pada pemulihan hubungan sosial (keadilan restoratif) serta pencegahan kemudaratan di masa depan, sehingga mediasi syariah tidak hanya berfungsi sebagai sarana penyelesaian sengketa, tetapi juga sebagai instrumen untuk mewujudkan kemaslahatan, menjaga keseimbangan hak dan kewajiban, serta membangun harmoni sosial yang berkelanjutan.

Abstract
This paper discusses the concept of justice in Islamic law and its implementation in the sharia mediation process using the maqāṣid al-syarī‘ah approach. Justice (al-‘adl) is a fundamental principle that forms the basis for law enforcement and dispute resolution in Islam, which is not only interpreted formally as procedural conformity, but also substantively as an effort to place rights proportionally and oriented towards the benefit. In dispute resolution, the value of justice is reflected in procedural justice (al-musāwah), substantive justice, and justice in peace (al-ṣulḥ). Sharia mediation as a non-litigation dispute resolution mechanism prioritizes the principles of equality, openness, deliberation, benefit, trustworthiness, and peace with the strategic role of the mediator in ensuring the achievement of justice through a neutral, fair, and integrity-based attitude. In the perspective of maqāṣid al-syarī‘ah, justice in mediation is not only oriented towards conflict resolution, but also towards restoring social relations (restorative justice) and preventing harm in the future, so that sharia mediation not only functions as a means of dispute resolution, but also as an instrument to realize the benefit, maintain the balance of rights and obligations, and build sustainable social harmony.
