ANALISIS TANGGUNG JAWAB HUKUM AFILIATOR SHOPEE TERHADAP PROMOSI PRODUK YANG MENYESATKAN PERSPEKTIF HUKUM EKONOMI SYARIAH

Abstrak
Perkembangan transaksi digital melalui program Shopee Affiliate telah meningkatkan efektivitas pemasaran, namun juga memunculkan praktik promosi yang menyesatkan dan berpotensi merugikan konsumen. Penelitian ini bertujuan untuk menganalisis tanggung jawab hukum afiliator Shopee atas tindakan penipuan dalam promosi produk berdasarkan perspektif Hukum Ekonomi Syariah serta hukum positif di Indonesia. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach), melalui kajian terhadap peraturan perundang-undangan, literatur hukum, dan konsep fikih muamalah. Hasil penelitian menunjukkan bahwa hubungan hukum dalam program afiliasi dapat dianalisis melalui akad ju'alah, Ijarah bi al-a’mal, dan samsarah. Afiliator yang secara sengaja menyampaikan informasi palsu atau menyesatkan tidak hanya kehilangan kehalalan komisi yang diperoleh menurut prinsip syariah, tetapi juga dapat dimintai pertanggungjawaban berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Oleh karena itu, afiliator wajib mengedepankan kejujuran, transparansi, dan tanggung jawab dalam setiap promosi. Disarankan agar afiliator memahami prinsip-prinsip syariah dan ketentuan hukum positif guna mewujudkan ekosistem perdagangan digital yang adil, aman, dan berintegritas.

Abstract
The development of digital transactions through the Shopee Affiliate Program has significantly enhanced marketing effectiveness but has also led to misleading promotional practices that may harm consumers. This study aims to analyze the legal liability of Shopee affiliates for fraudulent promotional activities from the perspectives of Islamic Economic Law and Indonesian positive law. The research employs a normative juridical method using statutory and conceptual approaches by examining relevant legislation, legal literature, and Islamic jurisprudential principles. The findings indicate that legal relationships within the affiliate program can be analyzed through the contracts of ju'alah, Ijarah bi al-a’mal, and samsarah. Affiliates who intentionally provide false or misleading information not only forfeit the legitimacy of the commissions they earn under Islamic law but may also be held legally liable under Law Number 8 of 1999 concerning Consumer Protection. Therefore, affiliates are required to uphold honesty, transparency, and accountability in every promotional activity. This study recommends that affiliates understand and comply with both Islamic legal principles and positive law in order to promote a fair, trustworthy, and ethical digital marketplace.
