Abstract
Constitutional Court Decision Number 100/PUU-XIII/2015 essentially held that an election with a single candidate may still be conducted democratically through a referendum-like mechanism that provides a blank column (empty box) as an alternative choice for voters. This decision became the legal milestone that gave rise to a new variant of regional head elections (Pilkada) in Indonesia: a single candidate versus an empty box. Since the decision, the single-candidate phenomenon has not declined; instead, it has shown a consistent upward trend from one election period to the next. Data compiled by the Association for Elections and Democracy (Perludem) show that in the 2015 simultaneous Pilkada there were only three single-candidate regions out of 269 participating regions (1.16%). This rose sharply to nine out of 101 regions in the 2017 Pilkada (8.91%), sixteen out of 171 regions in the 2018 Pilkada (9.36%), and twenty-five out of 270 regions in the 2020 Pilkada (9.26%). In the 2024 simultaneous Pilkada, 37 out of 545 participating regions experienced the single-candidate phenomenon. This study aims to examine and analyze the normative design of law enforcement in regional head elections with a single candidate pair from the perspective of the rule of law, as well as the dynamics of electoral law enforcement in the 2024 single-candidate Pilkada in Maros Regency. The findings show that the normative design of law enforcement for single-candidate regional head elections in Indonesia’s Pilkada legal system fulfills the principles of the rule of law only in a formal sense. Articles 54C and 54D of Law Number 10 of 2016 provide legal certainty regarding the conditions for holding such elections, the ballot format, and the consequences of a victory by the blank column. The dynamics of electoral law enforcement in the 2024 Maros Regency Pilkada show that the election organizers acted in accordance with procedures and remained neutral, yet law enforcement did not meet the substantive principles of the rule of law. Of the 10 reports and findings, none was proven to constitute an electoral crime; all 7 cases of alleged electoral offenses stopped at the preliminary investigation stage due to the difficulty of proving the element of intent within short deadlines and differing interpretations of the elements of the offense within the Integrated Law Enforcement Center (Sentra Gakkumdu).
